THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to his DD Form 214 (Certificate of Release or Discharge), for the period ending on 13 December 2011 to show his award of the Legion of Merit (LOM).

2.  He states his DD Form 214 was issued prior to him receiving this award.

3.  He provides his original LOM certificate and a copy of his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military record shows he was appointed in the South Carolina Army National Guard, as a second lieutenant, on 5 June 1981, with prior enlisted service.  He was promoted to colonel on 25 September 2009.  

2.  He was ordered to active duty in support of Operation Iraqi Freedom and entered active duty on 23 September 2010.  

3.  He provided and his records contain a certificate, dated 6 October 2011, awarding him the LOM for exceptionally meritorious service from 5 June 2001 to 4 June 2011 while serving in various positions of great responsibility and trust.  The certificate shows the LOM was issued by Permanent Orders Number 279-3.  

4.  He was honorably released from active duty on 13 December 2011 and he was transferred to the Retired Reserve.  His DD Form 214 for the period ending 13 December 2011 does not list the LOM.

DISCUSSION AND CONCLUSIONS:

PO awarded him the Legion of Merit for his exceptionally meritorious service from 5 June 2001 to 4 June 2011.  Therefore, he is entitled to correction to his DD Form 214 for the period ending 13 December 2011 to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Legion of Merit to the applicant's DD Form 214 for the period ending 13 December 2011.
