THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Legion of Merit (LOM).
2. The applicant states, in effect, that she was awarded an LOM.
3. The applicant provides a copy of a DA Form 638 (Recommendation for Award) dated 18 February 2009, a certificate for an LOM, and a copy of her DD Form 214 in support of her request.
CONSIDERATION OF EVIDENCE:
1. The applicant is a retired commissioned officer who entered military service on 15 August 1983. She was retired on 31 March 2008 and placed on the Retired List on 1 April 2008.
2. Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 lists several awards and decorations; however, it does not show award of the LOM.
3. Part V (Orders Data) of the applicant's DA Form 638 shows that Permanent Orders Number 099-05, Human Resources Command, dated 9 April 2009 awarded the applicant the LOM for exceptionally meritorious service in positions of increased responsibility, culminating a 24-year military career.
DISCUSSION AND CONCLUSIONS:
Permanent orders awarded the applicant the LOM for exceptionally meritorious service which is not shown on her DD Form 214; therefore, she is entitled to correction of her DD Form 214 to show this award.

In May 2012, he submitted the award (recommendation) to the 3rd Army and in June 2012 one of his Soldiers notified him that a brigadier general downgraded his award to a Meritorious Service Medal (MSM). Finally, in November before he left the command he asked the 3rd Army Commander to authorize his 3rd Army award section to revoke the award orders and remove the award from his record. The regulation shows that award orders are filed in the performance section of the OMPF.
