THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Meritorious Unit Commendation.

2.  The applicant states he believes his DD Form 214 should reflect all awards and decorations during the service period.

3.  The applicant provides:

* his DD Form 214 for the period ending 6 August 2010
* Permanent Orders 176-01, issued by the U.S. Army Human Resources Command (HRC), Fort Knox, KY, dated 25 June 2010
* Orders A-05-912827, issued by HRC, St. Louis, MO, dated 4 May 2009
* his DA Form 67-9 (Officer Evaluation Report) for the period 7 April 2009 through 6 April 2010

CONSIDERATION OF EVIDENCE:

1.  Having had prior enlisted service in the U.S. Air Force, the applicant was appointed as a Reserve officer in the U.S. Army Reserve (USAR) and he executed an Oath of Office on 22 October 1991.  He served in staff and leadership positions and he attained the rank of lieutenant colonel (LTC).


2.  Orders A-05-912827, dated 4 May 2009, ordered him to active duty in support of Operation Iraqi Freedom (OIF).  These orders directed his attachment to Headquarters and Headquarters Company (HHC), 82nd Airborne Division, with duty at Baghram, Afghanistan.

3.  He entered active duty on 13 June 2009.  He served in Afghanistan from 29 June 2009 to 23 May 2010 while assigned to HHC, 82nd Airborne Division.

4.  He was honorably released from active duty on 6 August 2010 at the completion of required active service in the rank of LTC and transferred back to his USAR unit.  He completed 1 year, 1 month, and 24 days of creditable active service during this period of service.

5.  The DD Form 214 he was issued for this period of service does not show the Meritorious Unit Commendation.

6.  The applicant provides Permanent Orders Number 176-01, dated 25 June 2010, wherein it shows that HHC, 82nd Airborne Division was awarded the Meritorious Unit Commendation for exceptionally meritorious service in Afghanistan during the period 30 April 2009 to 3 June 2010.

7.  Army Regulation 600-8-22 (Military Awards) states the Meritorious Unit Commendation is awarded to units for exceptionally meritorious conduct in the performance of outstanding services for at least 6 continuous months during the period of military operations against an armed enemy occurring on or after 1 January 1944.

8.  Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) states a Soldier is authorized a unit award permanently if the individual was attached by competent orders to, and present for duty with the unit during the entire period or for at 30 consecutive days of the period cited.

DISCUSSION AND CONCLUSIONS:

The evidence of record shows the applicant was attached to HHC, 82nd Airborne Division for more than 30 days during the period this unit was cited for award of the Meritorious Unit Commendation.  Therefore, his DD Form 214 should be corrected to show this unit award.

As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his DD Form 214 for the period ending 6 August 2010 the Meritorious Unit Commendation.
