IN THE CASE OF:
BOARD DATE: 31 July 2012
DOCKET NUMBER: AR20120002702
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of the social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the third digit as an "8."
2. The applicant states, in effect, his DD Form 214 incorrectly lists the third digit of his SSN as an "8."
3. The applicant provides a copy of his social security card showing the third digit of his SSN as an "8."
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 13 July 1966. During the enlistment process the applicant signed a DD Form 398 (Statement of Personal History) listing the third digit of his SSN as an "8."
3. At the time the applicant enlisted SSNs were not generally used; service numbers were used to identify Soldiers. In the applicant's case, when the SSN was used either an "8" or a "0" or a "6" was used.
4. The applicant was released from active duty on 12 July 1968. His DD Form 214 listed the third digit of his SSN as a 0.
DISCUSSION AND CONCLUSIONS:
The available evidence shows the applicant's DD Form 214 incorrectly lists the third digit of his SSN as a "0" when it should be listed as an "8." Therefore, the SSN on his DD Form 214 should be corrected.

Item 2 (Service Number) of the DD Form 214 in his record that was issued upon his separation correctly lists his SN using the number 8 as the second digit. However, although the copy of the DD Form 214 provided by the applicant appears to contain an incorrect number of 0 as the second digit of the SN in item 2, the DD Form 214 in his record clearly lists the correct number 8 as the second digit. As a result, the Board recommends that all Department of the Army records of the individual...

At the time the applicant was inducted he provided the SSN that is contained on his Social Security Card and he served his entire period of service using that SSN. The applicants DA Form 20 (Enlisted Qualification Record) that was created upon the applicant's entrance into the Army shows his SSN as xx5-xx-xxxxx. The DA Form 20 was audited on 16 December 1971 and the applicant authenticated this form by placing his signature in Item 47 (Signature of Individual). The evidence of records show the applicant used the number 4 as the third digit of his SSN when he enlisted. Therefore, lacking convincing independent and verifiable evidence to the...

His DD Form 47 (Record of Induction) does not show his SSN. These orders identify him using his military service number and also show his SSN with the first digit as a "2." His military service record contains a DA Form 428 (Application for Identification Card), dated 10 October 1968.

The applicant states his military record incorrectly shows the third digit of his SSN as 5 instead of 8. He goes on to state the Social Security Administration corrected the error when he first exited the Army and he never thought it would be an issue until now. The evidence of record shows the applicant's SSN contained a 5 as the third digit at the time of his induction and throughout his entire period of service. The applicant is advised that a copy of this decisional document...

The applicant states the SSN shown on his DD Form 214 is incorrect; the second and third digits of his SSN are 83 and not 38. Item 3 (SSN) of the DD Form 214 he was issued shows his SSN with the second and third digits as 38. DISCUSSION AND CONCLUSIONS: The evidence of record shows that upon the applicant's induction into the AUS, he listed his SSN with the second and third digits as 83 and this is the SSN he used throughout his active duty service.

The applicant's records contain the following documents showing his SSN as "X69-XX-XXXX": * DD Form 398 (Statement of Personal History), dated 4 March 1969 (typed) * DA Form 20 (Enlisted Qualification Record) * DD Form 214 3. However, his DA Form 1584, a document used by the FBI, clearly shows his proper SSN as "X96-XX-XXXX," which is also the SSN listed on the social security card he provided. As a result, the Board recommends that all Department of the Army records of the individual...
