THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 9 July 1967 to show his SSN as X77-XX-XXXX instead of X65-XX-XXXX.
2. He states the SSN shown on his DD Form 214 is incorrect.
3. He provides his social security card.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. His military records show he was inducted into the Army of the United States on 6 October 1965.
3. A DD Form 398 (Statement of Personal History) completed and signed by the applicant on 4 October 1965 reflects his SSN as X77-XX-XXXX.
4. He was honorably released from active duty on 9 July 1967 and transferred to the U.S. Army Reserve Control Group (Annual Training) to complete his remaining Reserve obligation. Item 3 of his DD Form 214 for this period of service shows his SSN as X65-XX-XXXX.
5. U.S. Army Reserve Components Personnel and Administration Center Letter Orders Number 09-1206685, dated 22 September 1971, show his SSN as
X77-XX-XXXX.
6. The social security card provided by the applicant shows his SSN as
X77-XX-XXXX.
DISCUSSION AND CONCLUSIONS:
1. His DD Form 398 and U.S. Army Reserve Components Personnel and Administration Center Letter Orders Number 09-1206685 show an SSN of
X77-XX-XXXX.
2. His DD Form 214 shows his SSN as X65-XX-XXXX. It appears the second and third digits of his SSN were transcribed in error on his DD Form 214. As such, it would be appropriate to correct his DD Form 214 to show his SSN as shown on his DD Form 398.
