IN THE CASE OF:
BOARD DATE: 10 July 2012
DOCKET NUMBER: AR20120000980
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his last name on his DA Form
87 (Department of the Army Certificate of Training), dated 16 December 1966.
2. The applicant states that his last name on his DA Form 87 should be corrected to show "Rxxxr" instead of "Rxxxv."
3. The applicant provides:
* his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge)
* a DA Form 87
* a State of Florida Certificate of Birth
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of
justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was inducted into the Army of the United States on
7 September 1966.
3. The applicants entire Military Personnel Records Jacket (MPRJ) shows his last name as Rxxxr except for his DA Form 87 that shows his last name as Rxxxv. On 18 June 1968, the applicant was honorably released from active duty. Item 32 (Signature of Person Being Transferred or Discharged) of his
DD Form 214 shows he signed his last name as "Rxxxr."
DISCUSSION AND CONCLUSIONS:
The applicant's DA Form 87, dated 16 December 1966 erroneously shows his last name as Rxxxv. His DD Form 214 and all other documents in his MPRJ confirm that his DA Form 87 is incorrect. Therefore, his DA Form 87 should be corrected to reflect his last name as Rxxxr as shown on his DD Form 214.
BOARD VOTE:
____x___ ____x___ ____x___ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by
amending his DA Form 87 (by issuing an appropriate cover document, if necessary) to show his last name as it is listed on his DD Form 214.

The applicant requests his social security number (SSN) be corrected on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 11 April 1968. Documents throughout his Military Personnel Records Jacket (MPRJ) identify him using his military service number. Army Regulation 635-5 (Separation Documents), in effect at the time, stated the SSN in item 3 of the DD Form 214 would be transcribed from the Soldier's DA Form 2139.

Application for correction of military records (with supporting documents provided, if any). The DA Form 20 (Enlisted Qualification Record) prepared and last audited by the applicant on 11 September 1965 lists his DOB as xx July xxxx in block 6 (DOB). The evidence of record confirms the applicant entered and performed his military service under the DOB of xx July xxxx, as evidenced by the DD Form 4 documenting his enlistment and the DA Form 20 on file.

The applicant's MPRJ is void of any orders or documents that indicate he was ever recommended for or awarded the BSM while serving in Vietnam or at any other time during his military service. Item 1 (Last Name-First Name-Middle Name) of his DD Form 214 list his last name as "Bxxhokxxxxx." Therefore, it would be appropriate to correct his DD Form 214 at this time to show his name as "Bxxhkxxxxx."

Additionally, he requests correction of his year of birth on his DD Form 214 for the period ending 3 May 1982 to show "1954" instead of "1955." Item 1 (Name) of his DD Form 214 for this period of service shows his last name as "Toro" and the year of birth as "1954." While it is understandable the applicant desires to now record his correct last name and year of birth in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Armys records...

The copy of the order awarding the applicant the Army Good Conduct Medal (General Orders Number 37, dated 5 August 1966, issued by the 39th Signal Battalion), which he provided in support of his request to the Board is also contained in his official military personnel file (OMPF) and reflected in item 41 (Awards and Decorations) of his DA Form 20 (Enlisted Qualification Record). However, the copy of the order awarding the applicant the Purple Heart (General Orders Number 87, dated 8 January...

Application for correction of military records (with supporting documents provided, if any). Item 3 (SSN) of the DD Form 214 he was issued at the time shows the entry "xxx-xx-xx9x." The evidence of record confirms the applicant entered active duty and he served under SSN "xxx-xx-xx6x" as listed on his DD Form 398 and DA Form 20, along with the majority of documents and orders in his MPRJ and confirmed in the SSA printout provided by the applicant.

The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty), with a separation date of 18 August 1995, to show her last name as "Gxx Arrxxxgui." She did not enlist using her full middle name and her full middle name is not shown anywhere in her MPRJ; however, she now requests to change the middle name shown on her DD Form 214 to show her full middle name. As a result, the Board recommends that all Department of the Army records of the...

The applicant requests his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 1 December 1966 be changed to show his first name as P______e instead of P___y and his date of birth (DOB) changed to show 14 August 1942 instead of 13 August 1942. Application for correction of military records (with supporting documents provided, if any). The DD Form 47 (Record of Induction) on file lists no middle name in item 1 (Last Name, First Name, Middle Name). The evidence of record confirms the applicant provided his correct name at the time of induction which did not include a middle name, as evidenced by the DD Form 47 and DD Form 398 completed during his induction processing.
