THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests her social security number (SSN) on her DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 14 June 1968, be corrected to show her SSN as shown in her Military Personnel Record Jacket (MPRJ).
2. The applicant states her SSN was entered on her DD Form 214 incorrectly and it makes it difficult to prove her service.
3. The applicant provides her:
* United States Uniformed Services Identification and Privilege Card
* DD Form 214
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. She enlisted in the Regular Army on 18 November 1965. Her DD Form 4 (Enlistment Record - Armed Forces of the United States) does not contain any entries or information concerning her SSN. At the time of her enlistment, military members were identified by a military service number.
3. The following documents in her MPRJ identified her with the same SSN, but not the SSN shown on her DD Form 214:
* DD Form 398 (Statement of Personal History), signed by her on
1 December 1965
* DA Form 3027 (U.S. Army Request for National Agency Check), dated
17 December 1965
* DA Form 41 (Record of Emergency Data), signed by her on 19 March 1968
4. On 14 June 1968, she was discharged. The SSN on her DD Form 214 is not the same SSN shown in her MPRJ.
5. Her records do not contain a DA Form 2139 (Military Pay Voucher).
6. Her SSN shown on her United States Uniformed Services Identification and Privilege Card is the same SSN shown in her MPRJ.
7. Army Regulation 635-5 (Separation Documents), in effect at the time, stated the SSN in item 3 (Social Security Number) of the DD Form 214 would be transcribed from the Soldier's DA Form 2139.
DISCUSSION AND CONCLUSIONS:
1. During the period of her service, Soldiers were primarily identified by their military service number. However, the DD Form 398, the DA Form 3027, the
DA Form 41, and her United States Uniformed Services Identification and Privilege Card identify her with the same SSN.
2. Therefore, it would be appropriate to change item 3 (Social Security Number) of her DD Form 214 to show her SSN as shown in her MPRJ.
