THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 1 November 2011 to show his total prior active service.

2.  The applicant states:

* his current DD Form 214 is missing 1 year, 2 months, and 23 days of active duty for his service in support of Operation Iraqi Freedom during the period 1 November 2003 to 9 February 2005
* his total prior active service only reflects 2 years and 15 days, but it should reflect 3 years, 3 months, and 8 days

3.  The applicant provides:

* DD Forms 214 for the periods ending 9 February 2005 and 1 November 2011
* discharge orders, dated 16 January 2005
* leave record
* active duty orders, dated 5 December 2003
* DA Form 1380 (Record of Individual Performance of Reserve Duty Training)



CONSIDERATION OF EVIDENCE:

1.  The applicant was ordered to active duty for training from the Army National Guard on 21 June 1990 as an enlisted Soldier.  He was released from active duty for training on 26 October 1990.

2.  His DD Form 214 for the period ending 26 October 1990 shows he completed 4 months and 6 days of active duty.

3.  He was commissioned as a second lieutenant on 13 July 1996 and accepted an appointment in the Army National Guard.

4.  He was again ordered to active duty for training from the Army National Guard on 8 June 1997.  He was released from active duty for training on 24 October 1997.

5.  His DD Form 214 for the period ending 24 October 1997 shows:

* he completed 4 months and 17 days of active duty during this period
* he had 4 months and 6 days of prior active service

6.  He was discharged from the Army National Guard on 8 June 2003 and transferred to the U.S. Army Reserve (USAR) on 9 June 2003.

7.  He was ordered to active duty from the USAR on 7 December 2003 in support of Operation Iraqi Freedom.  He served in Kuwait/Iraq from 28 January 2004 to 12 January 2005.  He was released from active duty on 9 February 2005.

8.  His DD Form 214 for the period ending 9 February 2005 shows:

* he completed 1 year, 2 months, and 3 days of active duty during this period
* he had 8 months and 23 days of prior active service

9.  He was again ordered to active duty from the USAR on 15 September 2006 in support of Operation Iraqi Freedom.  He served in Kuwait from 10 November 2006 to 5 November 2007.  He was released from active duty on 6 January 2008.

10.  His DD Form 214 for the period ending 6 January 2008 shows:

* he completed 1 year, 3 months, and 22 days of active duty during this period
* he had 1 year, 6 months, and 20 days of prior active service

11.  He entered active duty on 21 February 2008.  On 1 November 2011, he was honorably discharged.

12.  His DD Form 214 for the period ending 1 November 2011 shows:

* he completed 3 years, 8 months, and 11 days during this period
* he had 2 years and 15 days of prior active service

13.  His retirement points detail statement shows he also served on active duty from:

* 29 January to 3 February 2006
* 19 to 21 August 2005
* 3 to 5 June 2005
* 3 to 6 December 2003

14.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.  This regulation states that for item 12 (Record of Service), use extreme care in completing this block since post-service benefits, final pay, retirement credit, and so forth are based on this information.  It further states that for item 12d (Total Prior Active Service), enter the total amount of prior active military service less time lost, if any, from previously-issued DD Forms 214.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 for the period ending 1 November 2011 should be corrected to show he completed 3 years, 3 months, and 8 days of total prior active service.

2.  The evidence shows he had active duty service not covered by a DD Form 214.  Therefore, the U.S. Army Human Resources Command (HRC) should audit his military records and make the necessary adjustments to his active duty service on his DD Forms 214 as appropriate.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by having HRC audit his military records and make adjustments to his active duty service on his DD Forms 214 as appropriate.

2.  The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to amending his DD Form 214 for the period ending 1 November 2011 to show he completed 3 years, 3 months, and 8 days of prior active service at this time.
