THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the issuance of a DD Form 214 (Certificate of Release or Discharge from Active Duty) that captures her active duty while in an enlisted status. 

2.  The applicant states she plans to retire on 31 January 2012.

3.  The applicant provides:

* two DD Forms 4 (Enlistment/Reenlistment Document) and allied documents, dated 2 January 1986 and 2 October 1989
* DA Form 71 (Oath of Office - Military Personnel)
* DA Form 1059 (Service School Academic Evaluation Report)

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the U.S. Army Reserve on 2 January 1986.  She completed the required training for military occupational specialty (MOS) 88N (Traffic Management Coordinator) from 22 May 1988 to 3 June 1988.  

2.  She enlisted in the Regular Army for a period of 4 years on 2 October 1989 and held MOS 71L (Administrative Specialist).  She served through multiple reenlistments in a variety of stateside or overseas assignments and she attained the rank/grade of staff sergeant/E-6.

3.  She was discharged on 6 June 2001 for the purpose of accepting a commission.  Her DD Form 214 for her enlisted service is not available for review with this case.

4.  She was appointed as a Reserve commissioned officer in the rank of second lieutenant and executed an oath of office on 7 June 2001.  She served in a variety of stateside or overseas assignments and she attained the rank of major (MAJ).

5.  She states that she intends to retire on 31 January 2012. 

6.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The purpose of the separation document is to provide the individual with documentary evidence of his or her military service.  The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.  Paragraph 2-7c states not to issue a DD Form 214 to replace record copies or DD Forms 214 lost by Soldiers.  If no DD Form 214 is available, issue a statement of service or transcript of military record.

DISCUSSION AND CONCLUSIONS:

The applicant enlisted in the Regular Army on 2 October 1989.  She served through multiple reenlistments and she was discharged on 6 June 2001 to accept a commission.  She would have been issued a DD Form 214 on the date of her discharge prior to her commission.  The regulation states if no DD Form 214 is available, issue a statement of service or transcript of military record.  Therefore, she should be issued an appropriate document capturing this period of active service.

BOARD DETERMINATION/RECOMMENDATION:

1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by issuing her an appropriate document capturing her active duty service from
2 October 1989 to 6 June 2001. 

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to issuing a DD Form 214.
