THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests award of the Iraq Campaign Medal and its addition to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states the Iraq Campaign Medal is not listed on his DD Form 214.

3.  The applicant provides:

* deployment and travel orders
* Soldier Deployment History Outprocessing Report
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 26 September 2007 after having prior enlisted service.  He completed the training requirements and he was awarded military occupational specialty 25B (Information Technology Specialist).

2.  Orders were issued on 2 December 2008 temporarily reassigning him to Iraq in support of Operation Iraqi Freedom (OIF) with a reporting date of on or about 29 January 2009.

3.  A Soldier Deployment History Outprocessing Report, dated 29 December 2010, shows he served in a contingency operation from 24 January 2009 through 24 January 2010.

4.  He was honorably retired due to permanent disability on 20 February 2011.  He was credited with completing 3 years, 4 months, and 23 days of net active service with no lost time.

5.  His DD Form 214 lists the following awards:

* Army Achievement Medal
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Expeditionary Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Air Force Training Ribbon

6.  His DD Form 214 contains the entry "SERVICE IN KUWAIT FROM 20090128-20090814."

7.  A staff member of the Defense Finance and Accounting Service, Indianapolis, IN, verified the applicant received hostile fire/imminent danger pay and combat zone tax exclusion for service in Kuwait from 28 January 2009 through 11 August 2009.

8.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.

	a.  The Iraq Campaign Medal is awarded to members who served in direct support of OIF.  The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to 31 December 2011.  Approved campaigns are:

* Liberation of Iraq (19 March 2003-1 May 2003)
* Transition of Iraq (2 May 2003-28 June 2004)
* Iraqi Governance (29 June 2004-15 December 2005)
* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)
* 
Iraqi Sovereignty (1 January 2009-31 August 2010)
* New Dawn (1 September 2010-31 December 2011)

	b.  Service members who qualified for the Global War on Terrorism Expeditionary Medal by reasons of service between 19 March 2003 and 28 February 2005, in an area for which the Iraq Campaign Medal was subsequently authorized, will remain qualified for that medal.  

DISCUSSION AND CONCLUSIONS:

1.  The available evidence confirms the applicant served in Iraq from 28 January 2009 to 11 August 2009.  This period of service would have qualified him for award of the Iraq Campaign Medal with one bronze service star.

2.  The evidence shows the Global War on Terrorism Expeditionary Medal was erroneously added to the applicant's DD Form 214 at the time he was released from active duty.  He does not meet the criteria for this service award.  To have earned this service award, he would have had to serve in Iraq between 19 March 2003 and 28 February 2005.  He is not authorized this award and it should be removed from his DD Form 214.

3.  A staff member of the Board contacted the applicant on two occasions to inquire if he would like the Global War on Terrorism Expeditionary Medal removed from his DD Form 214.  He did not respond.  It is policy of this Board to not disadvantage an applicant outside of his or her stated issue and as such the Global War on Terrorism Expeditionary Medal will not be deleted from his DD Form 214 at this time.  The applicant may request deletion of this award at a later date.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Iraq Campaign Medal with one bronze service star to his DD Form 214.
