THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Purple Heart, Combat Action Badge, Army Commendation Medal, North Atlantic Treaty Organization (NATO) Service Medal, Afghanistan Campaign Medal, and the Global War on Terrorism Service Medal. 

2.  The applicant states these awards are not listed on his DD Form 214.  The paperwork was not available at the time of his discharge.  He was told a DD Form 215 (Correction to DD Form 214) would follow but he has not received anything.

3.  The applicant provides three orders, two certificates, DA Form 4187 (Personnel Action), and DA Form 638 (Recommendation for Award).

CONSIDERATION OF EVIDENCE:

1.  With respect to the applicant's request for award of the Purple Heart, Army Regulation 15-185 states the Army Board for Correction of Military Records will not consider any application if it determines the applicant has not exhausted all administrative remedies available to him/her.  There is no evidence the applicant submitted an application for award of the Purple Heart to the U.S. Army Human Resources Command (AHRC), ATTN: AHRC-PDP-A, 1600 Spearhead Division Avenue, Fort Knox, KY, 40122, and was denied this award.  Therefore, this portion of the applicant's request will not be discussed further in these Proceedings.
2.  The applicant's records show he enlisted in the North Carolina Army National Guard (ARNG) on 28 November 2007 and he held military occupational specialty 21B (Combat Engineer). 

3.  He was mobilized as a member of his ARNG unit in support of Operation Enduring Freedom and entered active duty on 7 November 2009.  He served in Afghanistan from 9 January to 29 May 2010 while assigned to 174th Engineer Company, 105th Engineer Battalion.

4.  Headquarters (HQ), U.S. Forces - Afghanistan Permanent Order Number 140-11, dated 20 May 2010, awarded him the Combat Action Badge for personally engaging or being engaged by the enemy on 2 April 2010.

5.  HQ, 105th Engineer Battalion, Afghanistan, Permanent Orders Number
054-36, dated 15 August 2010, awarded him the Global War on Terrorism Service Medal.

6.  HQ, 105th Engineer Battalion, Afghanistan, Permanent Orders Number
228-58, dated 16 August 2010, awarded him the Afghanistan Campaign Medal.

7.  HQ, U.S. Forces - Afghanistan Permanent Order Number 243-097, dated 31 August 2010, awarded him the Army Commendation Medal for exceptionally meritorious service in support of OEF.

8.  He was honorably released from active duty on 28 July 2010 by reason of completion of required active service.  He completed 8 months and 22 days of creditable active service.

9.  His DD Form 214 shows award of the National Defense Service Medal, Army Service Ribbon, Overseas Service Ribbon, and the Armed Forces Reserve Medal with "M" Device.

10.  The applicant provides a certificate for award of the NATO Medal for his service in operations in relation to the International Security Assistance Operation (Afghanistan) during the period 12 January to 6 November 2010.

11.  Army Regulation 600-8-22 (Military Awards) states the NATO Medal was authorized by the Secretary-General of the North Atlantic Treaty Organization for specific NATO operations.  The Secretary of Defense may approve acceptance and wear by U.S. service members who meet the criteria specified by the Secretary-General of NATO.  Acceptance of the NATO Medal has been approved for U.S. military personnel who serve under NATO command or operational control in direct support of NATO operations in Afghanistan from 1 January 2003 through a date to be determined.  To add the NATO Medal to a Soldier's record the Soldier must have been issued a certificate for this award.

DISCUSSION AND CONCLUSIONS:

Permanent Orders awarded the applicant the Combat Action Badge, Global War on Terrorism Service Medal, Afghanistan Campaign Medal, Army Commendation Medal, and he was issued a certificate for award of the NATO Medal.  Therefore, he is entitled to correction of his DD Form 214 to show these awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the following awards to item 13 of his DD Form 214:

* Combat Action Badge
* Global War on Terrorism Service Medal
* Afghanistan Campaign Medal
* Army Commendation Medal
* NATO Medal
