		BOARD DATE: 15 March 2012

		DOCKET NUMBER: AR20110018279

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests reconsideration of an earlier request to add the Combat Infantryman Badge (CIB) to his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2. The applicant states he was awarded the CIB on 5 April 1991 while serving in Southwest Asia.

3. The applicant provides orders for the CIB.

CONSIDERATION OF EVIDENCE:

1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110002421 on 25 August 2011.

2. The CIB orders are new evidence that will be considered by the Board.

3. The applicant enlisted in the Regular Army on 10 October 1989. He served as a fighting vehicle infantryman in Southwest Asia from 29 December 1990 to
5 August 1991. On 23 January 1992, he was honorably released from active duty.

4. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show the CIB as an authorized award.

5. He provided orders, dated 5 April 1991, which show he received the CIB.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20110002421, dated 25 August 2011. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the CIB to item 13 of his DD Form 214.

He was honorably released from active duty on 15 July 1991 to the control of his ARNG unit. With respect to his service in Korea, the evidence of record shows the applicant served in Korea as a rifleman to Company A, 2nd Battalion, 8th Cavalry from 22 May 1964 to 25 June 1965. Therefore, there is insufficient evidence to support awarding him the CIB for this period of service.

The applicant requests that his award of the Combat Infantryman Badge (CIB) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). The applicant states he was awarded the CIB in May 1991; however, it was not included on his DD Form 214 at the time of his release from active duty (REFRAD). Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Infantryman Badge (CIB) and any other medals and decorations that may have been given for Operation Desert Storm. The applicant provides no evidence. In the absence of evidence that the applicant actively participated in combat while assigned to an infantry unit, there is insufficient evidence upon which to base award of the CIB in this case.
