THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request to have the Presidential Unit Citation added to his awards.

2.  The applicant states that he was with the 89th Medium Tank Battalion from mid August 1950 until late September or early October 1951.  He bases his argument "on the fact that I have 5 bronze campaign stars…the time needed to acquire these would surely overlap at least one and maybe two of the time periods" for the Presidential Unit Citations presented to the 89th Medium Tank Battalion.

3.  The applicant provides copies of an Army History website printout of the campaign periods for the Korean War and the Record of Proceedings of the Boards previous consideration of his case.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100026742, on 3 May 2011.

2.  His contention that his service with the 89th Medium Tank Battalion must have coincided with one of the periods cited for the Presidential Unit Citation constitutes new argument that requires Board consideration.

3.  The applicant's records were lost or destroyed in the 1973 fire at the National Personnel Records Center in St. Louis.  The Board considered the available documents in an effort to provide the applicant an equitable decision.  

4.  Evidence shows the applicant had received the Bronze Star Medal with "V" Device for heroism in action against the enemy on 27 September 1950 and the Purple Heart for wounds sustained on the same day.  Both occurred while he was attached to the 89th Medium Tank Battalion.  That single day is the only day where the applicant's unit is definitively reflected in the record.  

5.  The original Record of Proceedings also notes that the 89th Medium Tank Battalion was awarded the Presidential Unit Citation for the periods:

* 21 April – 26 April 1951
* 26 May – 30 June 1951
* 11 September – 25 September 1951

DISCUSSION AND CONCLUSIONS:

1.  There is no available evidence to substantiate the applicant's assertion that he was with the 89th Medium Tank Battalion from mid August 1950 until late September or early October 1951.

2.  Unfortunately, 27 September 1950 is the only day during his service in Korea when the applicant's unit assignment is known.  Given the available records there is no way of knowing he assignment in 1951 when the 89th Medium Tank Battalion was cited for the Presidential Unit Citation.

3.  There is no basis for granting the applicant's requested relief.
