THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his social security number (SSN) on his DD Form 214 (Report of Separation from Active Duty) with an effective date of 25 June 1974 be corrected to reflect the SSN shown on his SSN card. 

2.  The applicant states his correct SSN is shown on his SSN card.

3.  The applicant provides his:

* DD Form 214 with an effective date of 25 June 1974
* Standard Form (SF) 88 (Report of Medical Examination), dated 21 May 1979
* SSN card

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  He enlisted in the U.S. Army Reserve (USAR) on 17 March 1973.  The following documents do not show the same SSN as that shown on his SSN card:

* DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States), dated 17 March 1973
* DD Form 1584 (National Agency Check Request), completed 1 March 1974
* Headquarters, First U.S. Army, Fort George G. Meade, MD Orders 33-1, dated 17 February 1978
* SF 88, dated 21 May 1979
* Item 3 (Social Security Number) of his DD Form 214 with an effective date of 25 June 1974 (provided by the applicant)

3.  On 4 April 1978, he enlisted in the Regular Army.  His enlistment document is not available for review.  The following documents in his MPRJ show the same SSN as that shown on his SSN card:

* Item 3 of his DD Form 214 with an effective date of 19 June 1979
* DD Form 4, dated 20 June 1979, for immediate reenlistment
* DD Form 4, dated 22 March 1982, for immediate reenlistment
* Item 3 of his DD Form 214 with an effective date of 30 May 1984

DISCUSSION AND CONCLUSIONS:

There is sufficient evidence to show his SSN is the same as that shown on his SSN card.  Therefore, it is appropriate to change the SSN on his DD Form 214 with an effective date of 25 June 1974 to the SSN as shown on his SSN card.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting Item 3 of his DD Form 214 with an effective date of 25 June 1974 to show his SSN as shown on his SSN card.
