THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show she was released from active duty (REFRAD) on 9 April 2011.

2.  The applicant states she separated on 9 April 2011 but her DD Form 214 shows her expiration date of service (ETS) as 9 April 2010.

3.  The applicant provides no additional evidence.

CONSIDERATION OF EVIDENCE:

1.  The applicant's DD Form 4 (Enlistment Document) shows she enlisted in the U.S. Army Reserve (USAR) Delayed Entry Program (DEP) on 11 March 2008.  She was discharged from the USAR DEP on 2 September 2008 and she enlisted in the Regular Army (RA) on 3 September 2008 for a period of 2 years and
30 weeks.

2.  Item 6 (Anticipated Date of Separation) of the applicant's DD Form 2648
(Pre-Separation Counseling Checklist), prepared on 2 August 2010, shows the entry 9 April 2011.

3.  Section III – Service Date of her Enlisted Record Brief (ERB) shows her ETS date as 9 April 2011.

4.  Orders 337-0141, issued by Headquarters, III Corps, Fort Hood, TX, dated 
3 December 2010, directed her reassignment to the Fort Hood Transition Center for transition processing with a reporting date of 9 April 2011.  However, these orders also show her date of REFRAD as 9 April 2010.

5.  The DD Form 214 she was issued at the time shows in:

* Item 12b (Separation Date This Period) her release date as 9 April 2010
* Item 12c (Net Active Service this Period) she completed 2 years,
7 months, and 7 days of creditable active service
* Item 21a/b (Member Signature/Date) this form was electronically signed by the applicant on 1 March 2011
* Item 22 a/b (Official Authorized to Sign) this form was electronically signed by a staff member of the Fort Hood Transition Center on 1 March 2011

6.  Army Regulation 635-5 (Separations Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of REFRAD, retirement, or discharge.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention that her DD Form 214 should be corrected to show she was REFRAD on 9 April 2011 vice 9 April 2010 has been carefully reviewed.

2.  Records show she enlisted in the RA on 3 September 2008 for a period of
2 years and 30 weeks, which equates to an ETS date of 9 April 2011.  Her
DD Form 2648 show her anticipated date of separation as 9 April 2011 and her separation orders show her reporting date to the transition point for processing as 9 April 2011.  Although her separation orders show a REFRAD date of 9 April 2010 it appears this date is incorrect as a result of a typographical error.

3.  Her DD Form 214 shows she was REFRAD on 9 April 2010; however, it also shows she completed 2 years, 7 months, and 7 days of creditable active service, which equates to a corresponding separation date of 9 April 2011.  Therefore, it would be appropriate at this time to correct her DD Form 214 to show her separation date as 9 April 2011.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 12b of her DD Form 214 the entry "2010  04  09" and replacing it with the entry "2011  04  09."
