THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the social security number (SSN) shown in Item 3 (SSN) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) ending on 14 November 1967.

2.  He states that his DD Form 214 does not show his correct SSN.  He has not worried about looking at his discharge document until recently.  When he was discharged he was just happy to be home and to see his family.  Also, he did not know the importance of the DD Form 214.  He was just worried and made sure it said honorable service.  

3.  He provides:

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a 
substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant’s military records show he was inducted into the Army of the United States on 8 December 1965.  His SSN is not listed on his DD Form 47 (Record of Induction).  At the time of his entry on active duty, he was assigned and identified throughout his military service with an Army Serial Number, which began with the prefix “US” for United States.  

3.  His record contains a DD Form 398 (Statement of Personal History), dated 9 December 1965, which shows the last four digits of his SSN as 8757.  

4.  His DA Form 20 (Enlisted Qualification Record) does not list his SSN.

5.  A DA Form 41 (Record of Emergency Data) and DD Form 398 (Statement of Personal History), dated 6 November 1967, shows the last four digits of his SSN as 8757.

6.  He was honorably released from active duty on 14 November 1967 and he was transferred to the U.S. Army Reserve Control Group (Annual Training).  He was issued a DD Form 214 showing in Item 3 (SSN) an SSN with only three last digits of 391.  

7.  In a letter, dated 2 June 2011, the Social Security Administration verified the SSN assigned to the applicant was xxx-xxx-8757. 

DISCUSSION AND CONCLUSIONS:

1.  The evidence of records confirms the last four digits of the applicant’s SSN are 8757.  It appears during the processing of his DD Form 214 a typographical error occurred when his SSN was entered in Item 3.  Therefore, he is entitled to correction to Item 3 on his DD Form 214 ending on 14 November 1967 to show his SSN as xxx-xx-8757.  

2.  In view of the foregoing, his records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

   a.  deleting the last three digits of the social security number shown in Item 3 on the applicant’s DD Form 214; and 
   
   b.  showing the last four digits of his social security number as 8757 in Item 3 of his DD Form 214.
