THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show his rank/grade as sergeant first class (SFC)/E-7.

2.  The applicant states the DD Form 214 was published prior to his promotion orders.

3.  The applicant provides Order Number 118-14, dated 28 April 2009.

CONSIDERATION OF EVIDENCE:

1.  The applicantÂ’s military records show that he enlisted in the Regular Army, on 2 October 1999, and he was awarded the military occupational specialties of infantryman and criminal investigation agent.

2.  On 1 April 2009, orders were issued placing the applicant on the temporary disability retired list (TDRL), effective 22 June 2009, in pay grade E-6.  

3.  On 28 April 2009, orders were issued promoting the applicant to the rank/pay grade of SFC/E-7, effective 21 June 2009.

4.  On 19 June 2009, orders were published amending the applicant's retired rank/pay grade to SFC/E-7.

5.  On 21 June 2009, he was retired and placed on the TDRL the following day.  The DD Form 214 he was issued shows his rank/pay grade as SSG/E-6.

DISCUSSION AND CONCLUSIONS:

1.  The applicant was promoted to the rank/pay grade of SFC/E-7 effective on the date of retirement.  As such, his DD Form 214 should be corrected to reflect this rank and pay grade.

2.  In view of the foregoing, the applicantÂ’s records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by changing his DD Form 214 for the period ending 21 June 2009 to show his rank/pay grade as SFC/E-7 with an effective date of pay grade of 21 June 2009.
