IN THE CASE OF:
BOARD DATE: 30 August 2011
DOCKET NUMBER: AR20110004189
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of item 12F (Foreign Service) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her service in Korea.
2. The applicant states she served in Korea from September 2007 to September 2008 but item 12f of her DD Form 214 does not reflect this.
3. The applicant provides:
* Four orders
* DA Form 638 (Recommendation for Award)
* DA Form 1059 (Service School Academic Evaluation Report)
* DA Form 2166-8 (NCO (Noncommissioned Officer) Evaluation Report (NCOER)
* Four Standard Forms 600 (Chronological Record of Medical Care)
CONSIDERATION OF EVIDENCE:
1. The applicant's records show she enlisted in the Regular Army on 29 January 2002 and held military occupational specialty 68W (Health Care Specialist).
2. A DA Form 2166-8, dated19 August 2008, shows she was rated for a 12 month period from September 2007 to August 2007 while assigned to the 302nd Brigade Support Battalion, 2nd Infantry Division, Yongsan, Korea.
3. A DA Form 2166-8, dated 11 March 2009, shows she was rated for a 7 month period from September 2008 to March 2009 while assigned to the 27th Engineer Battalion, Fort Bragg, NC.
4. She was honorably released from active duty on 16 May 2009 and she was transferred to the U.S. Army Reserve Control Group to complete her remaining Reserve obligation. She completed 7 years, 3 months, and 18 days of creditable active service.
5. Item 12f (Foreign Service) of her DD Form 214 shows the entry "0000 00 00."
6. The applicant provides Orders Number 255-112, dated 12 September 2007, issued by the 1st Replacement Company, Eighth U.S. Army, Seoul, Korea, which stated her arrival date to Korea was 10 September 2007.
7. As a related item, a review of her records indicates entitlement to additional awards.
8. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of her DD Form 214 does not show award of the Korea Defense Service Medal or the Overseas Service Ribbon.
9. Army Regulation 600-8-22 (Military Awards) provides for the following awards:
a. The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea. The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense.
b. The Overseas Service Ribbon is awarded for successful completion of overseas tours. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon.
DISCUSSION AND CONCLUSIONS:
1. The evidence of record shows the applicant successfully completed a tour of duty in Korea. Although the exact dates of her service cannot be determined, her records show her arrival date in Korea as 10 September 2007. As Korea is a 12 month tour, her departure date should have been on or about 9 September 2008. Therefore, it can be presumed she served in Korea for 12 months and she is entitled to correction of her DD Form 214 to show this foreign service.
2. She served in Korea during a qualifying period for award of the Korea Defense Service Medal and the Overseas Service Ribbon. Therefore, she is entitled to correction of her DD Form 214 to show these awards.
