THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 18 January 2008 to show award of the Army Commendation Medal (ARCOM), Global War on Terrorism Service Medal (GWOTSM), Global War on Terrorism Expeditionary Medal (GWOTEM), and Armed Forces Reserve Medal (AFRM) with "M" Device.

2.  The applicant states these four awards were omitted from his DD Form 214.

3.  The applicant provides a copy of his DD Form 214 for the period ending 18 January 2008.  [He indicated in his application that he had attached a copy of his DD Form 214 ending in December 2004, but it was not received].

CONSIDERATION OF EVIDENCE:

1.  His DD Form 214 for the period ending 11 September 2003 reports he served on active duty as a member of the U.S. Army Reserve (USAR).  He completed 5 months and 3 days of creditable active duty service during this period and was released to his USAR unit.

2.  His DA Form 2166-8 (Noncommissioned Officer Evaluation Report) for the period June through November 2004 reports the applicant served as a member of the USAR with the 415th Civil Affairs Battalion in Iraq.

3.  An ARCOM Certificate indicates Permanent Order Number 239-06, dated 26 August 2004, was published by the Commander, Engineer Brigade, Tikrit, Iraq, announcing award of the ARCOM to the applicant for his exceptionally meritorious service in support of Operation Iraqi Freedom while assigned as a member of the task force from 1 December 2003 to 30 November 2004.

4.  His DD Form 214 for the period ending 18 January 2008 shows he completed 3 months and 26 days of creditable active duty service during this period.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) lists the:

* National Defense Service Medal
* Army Service Ribbon

5.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.

	a.  The AFRM is awarded for honorable and satisfactory service as a member of one or more of the Reserve Components for a period of 10 years.  Also qualifying for this award are members who, on or after 1 August 1990, were called to active duty and served under Title 10, U.S. Code, sections 12301(a), 12302, 12304, 12406, or, in the case of the U.S. Coast Guard Reserve, Title 14, U.S. Code, section 712.  The member must have been called or volunteered and served on active duty in support of specific U.S. military operations or contingencies designated by the Secretary of Defense as defined in Title 10, U.S. Code, section 101(A)(13).  The “M” Device will be worn on the Armed Forces Reserve Medal to denote service by Reserve Component personnel who volunteered or were called to active duty during a mobilization or a contingency designated by the Secretary of Defense.

	b.  The GWOTSM is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal.  All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days are authorized the GWOTSM.

	c.  The GWOTEM is authorized for award to members of the Armed Forces of the United States who deployed abroad for service in Global War on Terrorism operations on or after 11 September 2001 to a date to be determined.  Deployment to Iraq in support of Operations Enduring Freedom and Iraqi Freedom is qualifying service.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 for the period ending 18 January 2008 should be corrected to show award of the ARCOM, GWOTSM, GWOTEM, and AFRM with "M" Device.

2.  The available evidence of record clearly shows the applicant was awarded the ARCOM for his meritorious service in Iraq during 2003-2004.  Furthermore, this service qualified him for award of the AFRM with "M" Device, GWOTSM, and GWOTEM.

3.  Therefore, these awards should be shown on his latest DD Form 214.

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.
