THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Infantryman Badge and his foreign service in Iraq from May to December 2007.

2.  The applicant states he served in Iraq from May to December 2007 and he was awarded the Combat Infantryman Badge at Fort Carson, CO, in 2008 after his deployment to Iraq.

3.  The applicant provides his DD Form 214, Enlisted Record Brief, orders, and an award certificate.

CONSIDERATION OF EVIDENCE:

1.  The applicant's records show he enlisted in the Regular Army on 14 September 2006 and he held military occupational specialty 11B (Infantryman).  He was assigned to the 12th Infantry Regiment, 4th Infantry Division.

2.  Permanent Orders Number 325-058, dated 21 November 2007, issued by Headquarters, Multi-National Division (Baghdad), awarded him the Combat Infantryman Badge for participating in ground combat operations under enemy hostile fire in Iraq on 6 April 2007 in support of Operation Iraqi Freedom (OIF).

3.  He was honorably released from active duty on 7 August 2010 by reason of completion of required active service and he was transferred to the U.S. Army Reserve Control Group (Reinforcement) to complete his remaining Reserve obligation.  He completed 3 years, 10 months, and 24 days of creditable active service.

4.  Item 12f (Foreign Service) of his DD Form 214 show he completed 11 months and 22 days of foreign service.  Additionally, item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of this form shows the:

* Afghanistan Campaign Medal with campaign star
* Army Commendation Medal (2nd Award)
* Army Good Conduct Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Army Service Ribbon
* Overseas Service Ribbon
* North Atlantic Treaty Organization Medal

5.  Item 18 (Remarks) of his DD Form 214 shows "SERVICE IN AFGHANISTAN 20090605-20100526."

6.  An email, dated 27 April 2011, from the Defense Finance and Accounting Service confirmed the applicant received hostile fire pay (HFP)/imminent danger pay (IDP) for service in Kuwait/Iraq from 10 March to 31 December 2007 (8 months and 21 days) and for service in Kuwait/Afghanistan from 7 September 2009 to 21 May 2010 (8 months and 14 days).

7.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  Item 12f of this DD Form 214 shows the total foreign service completed by the Soldier during the period covered by the DD Form 214.  Additionally, for a Soldier deployed to a foreign country, enter "SERVICE IN (Name of Country Deployed) FROM (inclusive dates, for example YYYYMMDD-YYYYMMDD)" in item 18.

8.  A review of his records indicates entitlement to additional awards which are not shown on his DD Form 214.

9.  Army Regulation 600-8-22 (Military Awards) states the Iraq Campaign Medal is awarded for service in direct support of OIF.  The area of eligibility encompasses all land area of the country of Iraq and the contiguous water area out to 12 nautical miles and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles.  The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to a future date to be determined.  A bronze service star is authorized for wear with this medal for participation in each credited campaign.  During his service in Iraq, he participated in the Iraqi Surge Campaign (10 January 2007-31 December 2008).

DISCUSSION AND CONCLUSIONS:

1.  Permanent orders awarded the applicant the Combat Infantryman Badge which is not shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show this award.

2.  He served in Kuwait/Iraq from 10 March to 31 December 2007.  Therefore, he is entitled to correction of his DD Form 214 to show his service in Kuwait/Iraq and the dates of his service.

3.  He served during a qualifying period for award of the Iraq Campaign Medal and he participated in one campaign during this period.  Therefore, he is entitled to award of the Iraq Campaign Medal with one bronze service star and correction of his DD Form 214 to show this award.

4.  He completed 8 months and 22 days of foreign service in Iraq and 8 months and 14 days of foreign service in Afghanistan, for a total of 1 year, 5 months, and 6 days of foreign service.  Item 12f of his DD Form 214 did not credit him with his complete period of foreign service.  Therefore, he is entitled to correction of his DD Form 214 to show completion of 1 year, 5 months, and 6 days of foreign service.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
* deleting from item 12f of his DD Form 214 the entry "0000  11  22" and adding the entry "0001  05  06"
* adding the Combat Infantryman Badge and the Iraq Campaign Medal with one bronze service star to item 13 of his DD Form 214
* adding the entry "SERVICE IN KUWAIT/IRAQ FROM 20070310-20071231" to item 18 of his DD Form 214.
