THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Army Good Conduct Medal
(4th Award) and the Army Commendation Medal (2nd Award).
2. The applicant states:
* He was medically discharged from his Army base with an incomplete
DD Form 214
* He received the orders for these awards on 27 December 2010
* His Army Good Conduct Medal and ETS [expiration term of service] award were pending when he went on transition leave
3. The applicant provides:
* Permanent Orders 251-05, dated 6 November 2010
* a DA Form 638 (Recommendation for Award), dated 20 October 2010
* his DD Form 214
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 20 November 2001. He completed his training and he was awarded military occupational specialty 92R (parachute rigger). On 13 December 2010, he was retired by reason of permanent disability after completing 9 years and 24 days of creditable active service.
2. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the:
* Army Commendation Medal
* Army Achievement Medal (2nd Award)
* Army Good Conduct Medal (2nd Award)
* National Defense Service Medal
* Afghanistan Campaign Medal with two bronze service stars
* Global War on Terrorism Expeditionary Medal
* Global War on Terrorism Service Medal
* Overseas Service Ribbon
* Parachutist Badge
* Parachute Rigger Badge
3. Permanent Order 251-05, issued by the 87th Quartermaster Detachment (Parachute), dated 6 November 2010, award him the Army Good Conduct Medal (4th Award) for the period 2 November 2007 to 1 November 2010.
4. There are no orders for his previous awards of the Army Good Conduct Medal contained in his available record or his interactive Personnel Electronic Records Management System (iPERMS) file.
5. Permanent Order 288-01, issued by the 10th Support Group, dated
2 November 2010, awarded the applicant the Army Commendation Medal (2nd Award) for meritorious service during the period 11 February 2007 to
20 November 2010. The reason for this award was his expiration of term of service.
6. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.
DISCUSSION AND CONCLUSIONS:
1. The orders provided by the applicant for the Army Good Conduct Medal
(4th Award) were carefully considered. However, there are no orders for the Army Good Conduct Medal in the available records and his DD Form 214 shows
entitlement to the Army Good Conduct Medal (2d Award). Since the governing regulation states a qualifying period of active enlisted service for award of the Army Good Conduct Medal is 3 years, and he only completed 9 years and
24 days of creditable active service, it appears the orders for the 4th award are incorrect; however, he would be eligible for a 3rd award of the Army Good Conduct Medal for the period 20 November 2007 through 19 November 2010. His 1st award would be for the period 20 November 2001 through 19 November 2004 and his 2nd award would be for the period 20 November 2004 through
19 November 2007. As such, his 3rd award should have been for the period
20 November 2007 through 19 November 2010. Therefore, it would be appropriate to amend Permanent Orders 251-05 to show he was awarded the Army Good Conduct Medal (3rd Award) for the period 20 November 2007 through 19 November 2010, and to correct his DD Form 214 to show this additional award of the Army Good Conduct Medal.
2. Permanent orders awarded the applicant the Army Commendation Medal (2nd Award). Therefore, his DD Form 214 should be corrected to show this award.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
a. amending Permanent Orders 251-05, dated 6 November 2010 to show award of the Army Good Conduct Medal (3rd Award) for the period 20 November 2007 through 19 November 2010;
b. deleting from item 13 of his DD Form 214 the Army Commendation Medal and the Army Good Conduct Medal (2nd Award); and
c. adding to item 13 of his DD Form 214 the:
* Army Commendation Medal (2nd Award)
* Army Good Conduct Medal (3rd Award)
2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to correcting his DD Form 214 to show any more than three awards of the Army Good Conduct Medal.
