THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reimbursement for nonpayment of an allotment to his mother in the amount of $40.00 per month.

2.  The applicant states he had an approved allotment for his mother but these monies were not forwarded to her.

3.  The applicant provides no supporting documentation.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.


2.  The applicant was inducted on 19 September 1951 and served on active duty through 18 July 1953.  He was promoted to sergeant on 27 March 1953.

3.  The applicant's available record does not contain any documentation of any allotments or other financial records.

4.  Contact with the Defense Finance and Accounting Service revealed that they did not have any pay records available for the applicant.

5.  Title 31, U.S. Code, section 3702 provides a 6-year statute of limitations on claims against the Government.

6.  Army Regulation 15–185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the Army Board for Correction of Military Records (ABCMR).  Paragraph 2-9 states that the ABCMR begins its consideration of each case with the presumption of administrative regularity.  The applicant has the burden of proving an error or injustice by a preponderance of the evidence.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's available recodes do not contain and the applicant has not provided any documentation related to a request for an allotment to his mother or whether or not such an allotment was or was not paid.  As such he has not demonstrated an error or injustice and, nearly 60 years later, the presumption of administrative regularity must be applied.
