BOARD DATE: 5 April 2011
DOCKET NUMBER: AR20100021955
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests award of the Combat Medical Badge.
2. The applicant states he was recently told that he was entitled to the Combat Medical Badge for his service as a medical corpsman in Vietnam.
3. The applicant provides copies of his DA Form 20 (Enlisted Qualification Record) and two DD Forms 214 (Report of Transfer or Discharge).
COUNSEL'S REQUEST, STATEMENT AND EVIDENCE:
1. Counsel requests that the applicant be awarded the Combat Medical Badge.
2. Counsel states the applicant served as a medical corpsman with the 1st Air Cavalry Division in Vietnam but was not awarded the Combat Medical Badge.
3. Counsel provides no additional supporting documentation.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the
3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant was inducted into the Army of the United States on 23 February 1968. On 29 February 1968 he was discharged for the purpose of enlisting in the Regular Army (RA). On 1 March 1968, he enlisted in the RA for a period of 3 years. He completed basic combat and advanced individual training and he was awarded military occupational specialty (MOS) 91A (Medical Corpsman). He also completed airborne training.
3. He served in Vietnam with Headquarters and Headquarters Support Battery, 1st Battalion, 21st Artillery Regiment, 1st Air Cavalry Division from 22 April 1969 through 4 April 1970 in duty MOS 91A and 91B2P (Field Medical Corpsman, parachute qualified).
4. The applicant was honorably released from active duty on 6 January 1971. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows the:
* National Defense Service Medal
* Vietnam Service Medal with two bronze service stars
* Republic of Vietnam Campaign Medal with Device (1960)
* Parachutist Badge
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
5. Army Regulation 600-8-22 (Military Awards) provides that the Combat Medical Badge is awarded to medical department personnel (colonels and below) who are assigned or attached to a medical unit of company or smaller size that is organic to an infantry unit of brigade, regimental or smaller size which is engaged in active ground combat. Battle participation credit is not sufficient; the infantry unit must have been in contact with the enemy.
DISCUSSION AND CONCLUSIONS:
1. While the applicant's service in Vietnam as a medical corpsman is not in question, he was a member of an artillery battery and regiment, not a medical
unit of company or smaller size that was organic to an infantry unit of brigade, regimental, or smaller size as required for award of the Combat Medical Badge. Furthermore, there is no evidence he was assigned to an infantry unit that was engaged in active ground combat.
2. In view of the foregoing, there is no basis for granting the applicant's requested relief.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
___x_____ ___x___ ___x_____ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Application for correction of military records (with supporting documents provided, if any). The applicant requests award of the Combat Medical Badge (CMB). Battle/combat service alone does not support award of the CMB.
ARMY | BCMR | CY2008 | 20080006081
The applicant held and performed duties related to the MOS, 91B (Medical Specialist) and specifically had the duty title, "Battery Aidman." The applicant alleges to have been awarded the Combat Medical Badge by his battalion commander while he served in Vietnam; however, he also states that he never received this award. There is no evidence, and the applicant provided none to show, he was ever assigned or attached to an infantry unit while he served in Vietnam.
ARMY | BCMR | CY2009 | 20090015714
His record is void of any documents showing he served as a combat medic with a qualifying infantry unit or that he was recommended for or awarded the CMB or CIB by proper authority while serving in SWA. The applicant's contention he qualified for the CMB and CIB based on his combat service in SWA in support of Operation Desert Storm has been carefully considered. The evidence of record shows the applicant held a medical MOS and not an infantry MOS.
ARMY | BCMR | CY2010 | 20100016711
The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Combat Infantryman Badge and Combat Medical Badge. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental, or smaller size; and b. the Combat Medical Badge is awarded to medical department personnel (colonel and below) who are assigned or attached to a medical unit of company or smaller size...
ARMY | BCMR | CY2009 | 20090007470
The applicant states, in effect, the BSM with "V" Device and BSM for meritorious service he earned are not listed on his DD Form 214, and he was a 91B (Medical Specialist) assigned to a rifle platoon and should have been awarded the CMB. Given the applicant's cavalry squadron commander confirmed in a 15 June 1968 request that the unit had an organic rifle platoon and that the applicant served as that platoon's medic and had been present with the unit on numerous occasions when it was...
ARMY | BCMR | CY2013 | 20130007034
The governing regulation for award of the CMB states the CMB may be awarded to medical department personnel who are assigned or attached to a medical unit of company or smaller size that is organic to an infantry unit of brigade, regimental or smaller size which is engaged in active ground combat. Unfortunately, the applicant has not provided any corroborating evidence showing he participated in ground combat with his infantry unit. Regrettably, there is insufficient evidence on which to...
ARMY | BCMR | CY2010 | 20100011604
Records show the applicant participated in one campaign during his assignment in Vietnam. This is sufficient evidence on which to base award of the Combat Medical Badge in this case. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him the Combat Medical Badge; and b. adding the Combat Medical Badge, Republic of Vietnam Campaign Medal with Device (1960), Republic of Vietnam Gallantry Cross with Palm Unit...
ARMY | BCMR | CY2010 | 20100017298
The evidence of record supports the applicant's request for correction of his DD Form 214 to show he was awarded the ARCOM and other awards. The evidence of record shows the applicant was assigned to an artillery unit during his service in Vietnam; therefore, he was not eligible for award of the CMB and he is not entitled to correction of his record to show this award. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a....

He provides information on an infantry unit commander and four enlisted infantry Soldiers who were assigned to his company and killed in action (during the period 21 January to 3 March 1969) while he was on missions with them. His DA Form 20 (Enlisted Qualification Record) shows he: * deployed overseas to Vietnam on 7 September 1968 and was assigned as: * Medical Corpsman (MOS 91A1O), Company B, 1st Medical Battalion, 1st Infantry Division, from 17 September 1968 to 8 January 1969 * Medical...
ARMY | BCMR | CY2014 | 20140007074
The applicant requests award of the Combat Medical Badge (CMB). His DA Form 20 (Enlisted Qualification Record) shows he served in Vietnam from 23 November 1966 to 13 October 1967. Army Regulation 600-8-22 (Military Awards) states the CMB is awarded to medical department personnel (colonel and below) who are assigned or attached to a medical unit of company or smaller size that is organic to an infantry unit of brigade, regimental or smaller size which is engaged in active ground combat.
