THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the Valorous Unit Award.

2.  He states his unit, the 4th Battalion, 31st Infantry Regiment, received a Valorous Unit Award (UVA) for the period 16 August 2006 to 20 June 2007.  He believes this award should be listed on his DD Form 214.  This error has occurred because his unit was awarded this citation after he had been honorably discharged.  

3.  He provides:

* Statement of Wartime Service
* DD Form 214
* Military Award Branch, Recently Approved Unit Awards website, for the 31st Infantry Regiment

CONSIDERATION OF EVIDENCE:

1.  His military records show he enlisted in the Delayed Entry Program on 29 June 2005.  He enlisted in the Regular Army in pay grade E-1 on 24 August 2005.  He completed training and was awarded military occupational specialty 

11B (infantryman).  He was assigned to Headquarters and Headquarters Company, 4th Battalion, 31st Infantry Regiment.

2.  A Statement of Wartime Service memorandum, dated 10 October 2007, certified his dates of deployment from 16 August 2006 through 29 October 2007 in support of Operation Iraqi Freedom.  The memorandum also showed his entitlement to wear the Shoulder Sleeve Insignia-Former Wartime Service and Iraq Campaign Medal for service in Iraq.

3.  He was honorably released from active duty in pay grade E-4 on 20 January 2008, for completion of required active service, and was transferred to a Reserve unit.  He was credited with completion of 2 years, 4 months, and 27 days of net active service.  He was also credited with 1 year, 2 months, and 12 days of foreign service credit.

4.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 lists the following awards:

* Army Commendation Medal (2nd Award)
* Army Achievement Medal
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Iraq Campaign Medal
* Army Service Ribbon
* Combat Infantryman Badge
* Air Assault Badge

5.  The Army Human Resources Command, Military Awards Branch, Recently Approved Unit Awards website, shows his unit, Headquarters and Headquarters Company, 4th Battalion, 31st Infantry Regiment, was awarded the Valorous Unit Award for the period 16 August 2006 - 25 June 2007, by pending Department of the Army General Orders.

DISCUSSION AND CONCLUSIONS:

1.  His unit was awarded the Valorous Unit Award.  Therefore, he is entitled to its addition to Item 13 of his DD Form 214.

2.  In view of the foregoing, his records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to Item 13 of his DD Form 214 the Valorous Unit Award and providing him a document showing this correction.
