THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 31 August 2007, to show the Legion of Merit (LOM) and the National Intelligence Achievement Medal.
2. The applicant states he received these awards after he out processed for retirement.
3. The applicant provides:
* a certificate for the award of the National Intelligence Achievement Medal
* a DA Form 638 (Recommendation for Award) of the LOM, dated 20 March 2007
* a certificate for the award of the LOM
CONSIDERATION OF EVIDENCE:
1. The applicant was commissioned a second lieutenant in the U.S. Army Reserve on 22 September 1995. He had 8 years, 1 month, and 11 days of prior active service.
2. On 31 August 2007, he retired by reason of sufficient service for retirement and he was placed on the Retired List the following day. Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 does not show award of the LOM or the National Intelligence Achievement Medal.
3. He was awarded the National Intelligence Achievement Medal by the Director of National Intelligence on 16 September 2008.
4. The DA Form 638 provided by the applicant shows the Human Resources Command, Alexandria, VA, approved the applicant's award of the LOM by Permanent Orders Number 201-38, dated 20 July 2007. The certificate for the award of the LOM contains the same orders data as on the DA Form 638.
DISCUSSION AND CONCLUSIONS:
The evidence shows he was awarded the Legion of Merit and the National Intelligence Achievement Medal. Therefore, his DD Form 214 should be corrected to show these two awards.
