      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the Legion of Merit (LOM) and
Global War on Terrorism Service Medal (GWOTSM) be added to his record.

2.  The applicant states, in effect, he received both of the awards in
question subsequent to his retirement.

3.  The applicant provides an award recommendation (DA Form 638) and LOM
Certificate in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s record shows that on 30 April 2003, he was honorably
separated for the purpose of retirement.  The separation document (DD Form
214) issued to him at this time shows he completed a total 24 years and 28
days of active military service, and that he held the rank of Chief Warrant
Officer Three (CW3).

2.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons
Awarded or Authorized) of the applicant’s DD Form 214 shows he earned the
following awards during his tenure on active duty:  Army Achievement Medal;
Defense Meritorious Service Medal; Meritorious Service Medal (3rd Award);
Joint Service Commendation Medal; Joint Meritorious Unit Award (3rd Award);
Army Superior Unit Award (2nd Award); Army Good Conduct Medal (3rd Award);
National Defense Service Medal with bronze service star; Armed Forces
Expeditionary Medal (2nd Award); Southwest Asia Service Medal with 1 bronze
service star; Humanitarian Service Medal; Noncommissioned Officer’s
Professional Development Ribbon with Numeral 3; Army Service Ribbon;
Overseas Service Ribbon (2nd Award); Kuwait Liberation Medal-Kuwait; Master
Parachutist Badge; Jumpmaster Badge; and Special Forces Tab.

3.  The applicant provides a DA Form 638 that confirms he was recommended
for the LOM, for meritorious service for the period 16 February 1993
through
15 February 2003 based on his 24 years of exceptionally meritorious
service.  He also provides an LOM Certificate that confirms this award was
approved and issued on 21 April 2003.

4.  Human Resources Command Message (Date Time Group 17 March 2004)
disseminated implementing instructions for award of the GWOTSM.  This award
is designated for Soldiers who have participated in or served in support of
Global War on Terrorism (GWOT).  All Soldiers on active duty, including
Reserve Component Soldiers mobilized or National Guard Soldiers activated,
on or after 11 September 2001 to a date to be determined having served 30
consecutive days or 60 nonconsecutive days are authorized this award.

DISCUSSION AND CONCLUSIONS:

The evidence of record includes an LOM recommendation and Certificate that
confirm the applicant was awarded the LOM on 21 April 2003.  Further, based
on his active duty service after 11 September 2001, he is also entitled to
the GWOTSM.  Thus, it would also be appropriate to add these awards to his
record and separation document at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
adding the Legion of Merit and Global War on Terrorism Service Medal to the
list of awards contained in Item 13 of his DD Form 214; and by providing
him a correction to his separation document that included these changes.
