THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request to correct his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his awards of the Army Commendation Medal (ARCOM).

2.  The applicant states the 82nd Division Commander signed the award recommendation awarding him an ARCOM on 24 January 1995.

3.  The applicant provides a copy of the DA Form 638 (Recommendation for Award).

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20090018492 on 6 May 2010.

2.  The original Record of Proceedings indicated that only the front side of the DA Form 638 was available for review.  As such, the Board determined it was insufficient evidence upon which to correct the applicant's records to show award of the ARCOM.

3.  The DA Form 638 provided by the applicant appears to be complete.  As such, it is new evidence requiring the Board's consideration.  This document indicates:

	a.  He was recommended for award of the ARCOM for the period 10 June 1991 to 7 January 1995.

	b.  He was previously awarded two ARCOM's.

	c.  He was recommended for this ARCOM based on distinguished meritorious service as a tank gunner.

	d.  His chain of command recommended approval.

	e.  The recommendation was approved by a brigadier general.

	f.  Permanent Order Number 13-37, dated 24 January 1995, was issued awarding the applicant the ARCOM with two oak leaf clusters.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends his DD Form 214 should be corrected to show his awards of the ARCOM.

2.  The available evidence clearly shows the applicant was recommended for a third award of the ARCOM.  Furthermore, the DA Form 638 appears to have been properly processed through his chain of command and approved by the appropriate authority.  Orders were issued for award of the ARCOM with two oak leaf clusters.  Therefore, it would be appropriate to show these awards on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant amendment of the ABCMR's decision in Docket Number AR20090018492, dated 6 May 2010.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing on his DD Form 214 award of the Army Commendation Medal with two oak leaf clusters.
