BOARD DATE: 7 December 2010
DOCKET NUMBER: AR20100014383
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests his financial records and his retirement certificate be corrected to show his first name as Edward instead of Edeard. He also requests his beneficiary be changed to his current wife.
2. The applicant states his first name is misspelled on his financial records and his retirement certificate. He states his first wife is deceased and he has remarried.
3. The applicant provides copies of:
* his marriage certificate to his current wife Linda
* the death certificate for his first wife Phyllis
* his driver's license and social security card
CONSIDERATION OF EVIDENCE:
1. The applicant's request to change his beneficiary is unclear as to what he is referring to. If he is trying to update the beneficiary on his Survivor Benefit Plan (SBP) there is no action for the Board to take. He must contact Defense Finance and Accounting Service (DFAS), London, KY, toll free number 1-800-321-1080. The staff of the Army Board for Correction of Military Records (ABCMR) attempted to contact the applicant via the email address he provided on his application concerning this issue. However, no response was received. Therefore, this issue will not be discussed further in this Record of Proceedings.
2. The applicant was commissioned a second lieutenant in the North Carolina Army National Guard (NCARNG) on 21 August 1976. He was commissioned a second lieutenant in the U.S. Army Reserve (USAR) on 20 May 1977. His orders for appointment and his oath of office show his first name as Edward and his social security number (SSN) as ***-**-3551.
3. On 1 March 1985, the applicant was separated from the NCARNG and transferred to Company D, 3rd Battalion, 108th Regiment, 4th Brigade, 108th Division, USAR, Raleigh, NC. His orders identify him with the first name of Edward and SSN ***-**-3551.
4. On 26 July 1992, the applicant was assigned to the Retired Reserve. His orders identify him with the first name of Edward and SSN ***-**-3551.
5. U.S. Army Human Resources Command (HRC), St. Louis, MO, AHRC-PAP-T Orders P11-911800, dated 30 November 2009, placed the applicant on the Retired List effective 1 December 2009. However, he is identified with the first name of Edeard and SSN ***-**-3551.
6. The applicant is identified throughout his official military personnel file (OMPF) with the first name of Edward and SSN ***-**-3551.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends his first name is misspelled on his retirement certificate.
2. The applicant is identified throughout his OMPF with the first name of Edward. Therefore, his first name on his orders for placement on the Retired List is obviously misspelled. These orders should be amended to show his first name as Edward.
3. The applicant did not provide a copy of his retirement certificate. However, since his first name is misspelled on his retirement orders, it is reasonable to conclude his first name was misspelled on the retirement certificate. Therefore, it is appropriate to issue the applicant a new retirement certificate showing his first name as Edward.
4. Based upon the correction to his retirement orders, DFAS should correct the spelling of his name on his finance records.

By law and regulation, members electing Option A under the RCSBP remain eligible to elect SBP coverage at age 60; however, an annuity will not be payable to beneficiaries if the member dies before age 60. In view of the facts of this case, absent a written concurrence from the applicant waiving her rights to SBP coverage, it would be appropriate and serve the interest of justice to correct the FSM's record to show he elected RCSBP spouse coverage at full base amount, Option B (RCSBP...

On 17 July 2014, he was informed by Mr. T____ E____, VA Education Services, that the application for the TEB option should have been offered to him prior to separation from the service. However, this was the first time he learned there was a requirement to be approved for TEB prior to separation from the service and this option should have been offered to him upon his release from the NCARNG and at the time of retirement. He is asking that the Board correct his records to show he requested...

The applicant states he was in an O-5 slot from 9 June 2009 until 13 July 2009. He states he is being penalized for being involuntarily cross-leveled for deployment to Iraq, resulting in over 3 months of lost time in rank. Therefore, notwithstanding the advisory opinion received from HRC-St. Louis, it would be equitable and just to correct the applicant's records to show he was promoted to lieutenant colonel with an effective date and DOR of 9 June 2009, with entitlement to back pay and...

The applicant, the father of a deceased former service member (FSM), requests, in effect, correction of the FSM's DD Form 93 (Record of Emergency Data). This request is interpreted as a request to establish Reserve Component Survivor Benefit Plan (RCSBP) beneficiary eligibility for the FSM's spouse. The applicant contends, in effect, that the FSM's records should be corrected to show that he elected RCSBP coverage for his spouse.

Counsel states the following: a. the applicant initially requested a survivor benefit annuity on 23 February 2006 but was denied by Human Resources Command (HRC), St. Louis, MO because the FSM elected Survivor Benefit Plan (SBP) spouse coverage for his first wife. The FSM's military record contains a DD Form 1883, dated 19 September 1993, which shows in section II, Item 8 that he elected SBP coverage for spouse and children and in 9c that he elected Option C (Immediate coverage). As a...
