THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests his financial records and his retirement certificate be corrected to show his first name as Edward instead of Edeard. He also requests his beneficiary be changed to his current wife. 2. The applicant states his first name is misspelled on his financial records and his retirement certificate. He states his first wife is deceased and he has remarried. 3. The applicant provides copies of: * his marriage certificate to his current wife Linda * the death certificate for his first wife Phyllis * his driver's license and social security card CONSIDERATION OF EVIDENCE: 1. The applicant's request to change his beneficiary is unclear as to what he is referring to. If he is trying to update the beneficiary on his Survivor Benefit Plan (SBP) there is no action for the Board to take. He must contact Defense Finance and Accounting Service (DFAS), London, KY, toll free number 1-800-321-1080. The staff of the Army Board for Correction of Military Records (ABCMR) attempted to contact the applicant via the email address he provided on his application concerning this issue. However, no response was received. Therefore, this issue will not be discussed further in this Record of Proceedings. 2. The applicant was commissioned a second lieutenant in the North Carolina Army National Guard (NCARNG) on 21 August 1976. He was commissioned a second lieutenant in the U.S. Army Reserve (USAR) on 20 May 1977. His orders for appointment and his oath of office show his first name as Edward and his social security number (SSN) as ***-**-3551. 3. On 1 March 1985, the applicant was separated from the NCARNG and transferred to Company D, 3rd Battalion, 108th Regiment, 4th Brigade, 108th Division, USAR, Raleigh, NC. His orders identify him with the first name of Edward and SSN ***-**-3551. 4. On 26 July 1992, the applicant was assigned to the Retired Reserve. His orders identify him with the first name of Edward and SSN ***-**-3551. 5. U.S. Army Human Resources Command (HRC), St. Louis, MO, AHRC-PAP-T Orders P11-911800, dated 30 November 2009, placed the applicant on the Retired List effective 1 December 2009. However, he is identified with the first name of Edeard and SSN ***-**-3551. 6. The applicant is identified throughout his official military personnel file (OMPF) with the first name of Edward and SSN ***-**-3551. DISCUSSION AND CONCLUSIONS: 1. The applicant contends his first name is misspelled on his retirement certificate. 2. The applicant is identified throughout his OMPF with the first name of Edward. Therefore, his first name on his orders for placement on the Retired List is obviously misspelled. These orders should be amended to show his first name as Edward. 3. The applicant did not provide a copy of his retirement certificate. However, since his first name is misspelled on his retirement orders, it is reasonable to conclude his first name was misspelled on the retirement certificate. Therefore, it is appropriate to issue the applicant a new retirement certificate showing his first name as Edward. 4. Based upon the correction to his retirement orders, DFAS should correct the spelling of his name on his finance records.
