THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the Social Security Account Number (SSAN) shown in Block 32 (Remarks) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to X0X-XX-XXXX vice 
X7X-XX-XXXX.

2.  The applicant states his SSAN is incorrect.

3.  The applicant provides:

* DD Form 214
* Veterans Administration Certificate of Eligibility
* Medicare Card

4.  Under separate cover, the applicant provided a Social Security Administration Social Security Number [Computer] Printout.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant served in the Regular Army from 21 November 1961 through 9 November 1964.  When he was enlisted, he was given a Service Number which he used throughout his period of service.  During the 1960's the Army began transitioning from Service Numbers to SSANs as a means of identifying Soldiers. The final changeover date from Service Number to SSAN was 1 July 1969 for all Soldiers.

3.  The applicant's records contain a DA Form 24 (Service Record).  This document has no block for recording the SSAN; however, in the "Name and Service Number" block, the entry "SSAN:  X7X-XX-XXXX" is typewritten.  This document does not bear the applicant's signature.

4.  The applicant's records contain a DA Form 41 (Record of Emergency Data), dated 20 July 1964.  This document lists the applicant's SSAN as X0X-XX-XXXX. The document is signed by the applicant.

5.  All of the evidence provided by the applicant conclusively proves his SSAN is X0X-XX-XXXX, not X7X-XX-XXXX.

DISCUSSION AND CONCLUSIONS:

1.  The applicant wants his SSAN corrected on his DD Form 214.

2.  The applicant was issued SSAN X0X-XX-XXXX by the Social Security Administration.  When he entered the Army SSANs were not used to identify Soldiers; the Army Service Number was used.

3.  During the lengthy transition period from Service Numbers to SSANs, the Army incorrectly listed the applicant's SSAN as X7X-XX-XXXX on his DA Form 24.  However, the applicant completed and signed a DA Form 41 showing his SSAN as X0X-XX-XXXX.

4.  The applicant's correct and only SSAN according to the Social Security Administration is X0X-XX-XXXX.

5.  The applicant's DD Form 214 should be corrected.
