THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests item 13 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show all of the awards that he earned.

2.  The applicant states that his most recent DD Form 214 does not show all of the badges and awards he earned during his previous tour of duty.

3.  The applicant provides a copy of his 16 October 2006 and 4 March 2010
DD Forms 214 in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s military record shows he initially enlisted in the United States Army Reserve (USAR) on 18 November 2003, for a period of 8 years.  On 20 September 2005, he was ordered to active duty as a member of the USAR in support of Operation Iraqi Freedom (OIF).

2.  On 16 October 2006, the applicant was honorably released from active duty (REFRAD) and transferred to his USAR unit.  The DD Form 214 issued to him at that time shows he completed 1 year and 27 days active federal service of which 11 months and 4 days was foreign service.

3.  The DD Form 214 confirms that the applicant served in Iraq from 20 October 2005 to 23 September 2006.  It also shows that he earned the following awards:

* National Defense Service Medal (NDSM)
* Global War on Terrorism Service Medal (GWOTSM)
* Iraq Campaign Medal (ICM)
* Army Service Ribbon (ASR)
* Overseas Service Ribbon (OSR)
* Armed Forces Reserve Medal with “M” Device (AFRM w/M Device)

4.  On 16 January 2009, the applicant was ordered to active duty in support of Operation Enduring Freedom (OEF) and he served until he was REFRAD by reason of completion of required active service on 4 March 2010.  The DD Form 214 issued to him at that time shows he completed 1 year, 1 month, and 19 days active federal service of which 10 months and 28 days was foreign service.

5.  The 4 March 2010 DD Form 214 confirms the applicant served in Afghanistan from 15 February 2009 to 9 January 2010.  It also shows that he earned the following awards:

* Afghanistan Campaign Medal (ACM) with campaign star
* NDSM
* GWOTSM
* ASR
* OSR
* AFRM w/M Device

6.  The applicant’s Official Military Personnel File (OMPF) contains an Army Commendation Medal (ARCOM) certificate awarded to him for exceptional meritorious service during the period 16 February 2009 to 12 January 2010.  It shows that this award was announced in Headquarters, 45th Joint Logistics Command, Permanent Orders Number 218-24 dated 6 August 2009.

7.  Army Regulation 635-5 prescribes the separation documents that are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  Paragraph 2-4h(13) states to list awards and decorations for all periods of service in priority, as listed in the Army’s awards regulation.

8.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy and criteria concerning individual military awards.  Paragraph 2-17 contains guidance on the ICM.  It states, in pertinent part, that it is authorized for service in Iraq from 19 March 2003, to a future date to be determined by the Secretary of Defense or the cessation of the operation.  A bronze service star is authorized with this award for each Iraq campaign a member is credited with participating in.  During the applicant's tenure of assignment, participation credit was granted for the Iraq Governance (29 June 2004 – 15 December 2005) and National Resolution (16 December 2005 – 9 January 2007) campaigns.

9.  Paragraph 5-4 of the awards regulation provides guidance on the award of the OSR.  It states, in pertinent part, that it is authorized for completion of normal overseas tours as defined in Army Regulation 614-30 (Overseas Service).  Numerals are used to denote the second and subsequent awards of the OSR.  Table 3-2 of Army Regulation 614-30 identifies tour completion criteria and states, in pertinent part, that in order to receive tour credit for temporary change of station/temporary duty service in isolated areas where tour lengths have not been established (Iraq/Afghanistan), a member must complete 11 cumulative months in a 24-month period or 9 continuous months.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends his 4 March 2010 DD Form 214 should be corrected to show all of the awards he earned.

2.  The evidence of record shows that the applicant was awarded the ARCOM and it was announced in official orders during his most recent period of active duty service.  The ARCOM it is not included in the list of awards shown in item 13 of his 4 March 2010 DD Form 214 and therefore should be added to this separation document at this time.

3.  The evidence of record confirms that the applicant received the ICM for his service performed in support of OIF as evidenced on his 16 October 2006 DD Form 214 and this award is not included on his final DD Form 214 issued on 4 March 2010.  In addition, the applicant participated in the Iraq Governance and National Resolution campaigns which entitles him to two bronze service stars with the ICM.  Therefore, the ICM with 2 bronze service stars should be added to item 13 of the applicant’s 4 March 2010 DD Form 214 at this time.

4.  The evidence of record also confirms the applicant completed 11 months and 4 days service in Iraq from 20 October 2005 to 23 September 2006, and 10 months and 28 days service in Afghanistan from 15 February 2009 to 9 January 2010, as evidenced by his 16 October 2006 and 4 March 2010 DD Forms 214.  Accordingly, he completed two separate periods of oversea service and he is therefore entitled to the OSR with Numeral 2 to signify two of these awards.

5.  In view of the foregoing, the applicant's records should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 13 of his 4 March 2010 DD Form 214 by adding the Army Commendation Medal, Iraq Campaign Medal with 2 bronze service stars, and the Overseas Service Ribbon with Numeral 2; and by issuing him a correction to this DD Form 214 that reflects these awards.
