THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 6 June 2011 to: a. add all primary specialties to item 11 (Primary Specialty); b. add the following awards to item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized): * Army Achievement Medal (AAM) (4th Award) * Afghanistan Campaign Medal (ACM) * Global War on Terrorism Expeditionary Medal (GWOTEM) with arrowhead * Overseas Service Ribbon (OSR) (Numeral 2) * Basic Marksmanship Qualification Badge c. add all education courses to item 14 (Military Education). 2. The applicant states the errors he has listed were included on a previous DD Form 214 for the period ending 24 July 2008 when he was appointed as warrant officer in the Army, and on his previous Enlisted Record Brief (ERB) and Officer Record Brief (ORB). 3. The applicant provides: * two DD Forms 214 * ERB, prepared on 14 May 2007 * ORB, prepared on 20 May 2011 CONSIDERATION OF EVIDENCE: 1. The applicant had prior service in the Army National Guard. He enlisted in the Regular Army on 5 January 2001. On 24 July 2008, he was honorably discharged from active duty to accept appointment as a warrant officer. 2. Item 11 of the applicant's DD Form 214 for the period ending 24 July 2008 shows military occupational specialties: * 94E2O Radio and Communications Security Repairer - 3 years and 5 months * 25U2O Signal Support Systems Specialist - 7 years and 6 months 3. Item 13 shows: * Meritorious Service Medal * Army Commendation Medal (4th Award) * AAM (4th Award) * Meritorious Unit Commendation (2nd Award) * Valorous Unit Award * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * ACM * GWOTEM with arrowhead * GWOTEM * Global War on Terrorism Service Medal * Iraq Campaign Medal (ICM) with two bronze service stars * Noncommissioned Officer Professional Development Ribbon (numeral 2) * Army Service Ribbon * OSR (numeral 2) * Army Reserve Component Overseas Training Ribbon * Combat Action Badge * Basic Marksmanship Qualification Badge 4. Item 14 shows: * Primary Leadership Development Course - 4 weeks, 2002 * Hazardous Material Certification - 2 weeks, 2004 * Combat Life Savers Course - 1 week, 2004 * Combatives Level 1 - 1 week, 2006 * Basic Noncommissioned Officer Course - 8 weeks, 2006 * Warrant Officer Candidate School - 2008 5. Item 18 shows the applicant served in: * Afghanistan from 5 January 2002 to 15 July 2002 * Afghanistan from 2 June 2005 to 2 September 2005 * Afghanistan from 1 December 2005 to 1 June 2006 6. Section I (Assignment Information) of the applicant's ERB show he was deployed to Iraq from 1 March 2003 to 4 February 2004. Section VII (Awards and Decorations) shows the applicant was awarded the GWOTEM with arrowhead. 7. On 25 July 2008, the applicant was appointed as a warrant officer and entered active duty. On 6 June 2011, he was discharged from active duty. 8. Item 11 of his DD Form 214 for the period ending 6 June 2011 shows the entry "254A0 Signal [Systems] Support - 2 YRS 4 MOS." 9. Item 13 of this DD Form 214 shows: * Meritorious Service Medal * Army Commendation Medal (4th Award) * AAM (3rd Award) * Meritorious Unit Commendation (2nd Award) * Valorous Unit Award * Army Good Conduct Medal (2nd Award) * National Defense Service Medal * ACM * GWOTEM * Global War on Terrorism Service Medal * ICM with two bronze service stars * Noncommissioned Officer Professional Development Ribbon (numeral 2) * Army Service Ribbon * OSR (numeral 3) * Army Reserve Component Overseas Training Ribbon * Combat Action Badge 10. Item 14 of this DD Form 214 shows: * Warrant Officer Basic Course Security - 1 week, 2008 * Signal Systems Support Technician Warrant Officer Basic Course - 20 weeks, 2009 11. Item 18 shows the applicant served in Iraq from 30 June 2009 to 30 June 2010. 12. A review of the applicant's Army Military Human Resource Record (AMHRR) shows he was awarded four AAM's announced by: * Permanent Orders 3-2, dated 30 November 1999, issued by Headquarters (HQ), 112th Military Police Battalion * Permanent Orders 248-006, dated 5 September 2001, issued by HQ, 3rd Brigade, 101st Airborne Division (Air Assault) * Permanent Orders 075-0022, dated 23 March 2005, issued by HQ, 1st Battalion, 187th Infantry Regiment, 10st Airborne Division (Air Assault) * Permanent Orders 136-4, dated 15 May 2008, issued by HQ, 86th Signal Battalion 13. In an e-mail to a Board analyst, dated 17 May 2013, the applicant stated he would prefer award of the ACM vice GWOTEM. 14. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army and establishes standardized policy for the preparation of the DD Form 214. It states the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty, providing a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. a. It states for item 11, from the ERB, enter the titles of all MOS's served for at least 1 year during the period covered by the DD Form 214. Include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training (AIT). For warrant officers, also enter the 4-character MOS and the fifth character for skill qualification identifier, with appropriate title and time in specialty. b. It states for item 13, list awards and decorations for all periods of service. Each entry will be verified by the Soldier's records. c. It states for item 14, from the ERB/ORB, list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the Soldier in job placement and counseling; therefore, do not list training courses for combat skills. 15. Army Regulation 600-8-22 (Military Awards) provides Department of the Army policy, criteria, and administrative instructions concerning individual military decorations. a. The ACM is awarded to members who have served in direct support of Operation Enduring Freedom (OEF). The area of eligibility encompasses all the land area of the country of Afghanistan and all air spaces above the land area. The period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. Service members must have been assigned, attached, or mobilized to units operating in the area of eligibility for 30 consecutive days or for 60 non-consecutive days. Under no condition will personnel or units receive the ACM, the GWOTEM, the GWOTSM, the ICM, or the Armed Forces Expeditionary Medal for the same action, time period, or service. b. Army Regulation 600-8-22 further states service members qualified for the Global War on Terrorism Expeditionary Medal by reason of service between 24 October 2001 and 28 February 2005, in an area for which the Afghanistan Campaign Medal was subsequently authorized, will remain qualified for that medal. Upon application, any such service member may be awarded the Afghanistan Campaign Medal in lieu of the Global War on Terrorism Expeditionary Medal for such service. No service member will be entitled to both medals for the same act, achievement, or period of service. A bronze service star is authorized for wear with this medal for participation in each credited campaign. During the applicant's service in Afghanistan he participated in one campaign: Consolidation I (1 December 2001 - 30 September 2006). c. The ICM is awarded to members who have served in direct support of Operation Iraqi Freedom (OIF). The area of eligibility encompasses all the land area of the country of Iraq, the contiguous water area out to 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles. The ICM period of eligibility is on or after 19 March 2003 through 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. During the applicant's service in Iraq, he participated in three campaigns: * Liberation of Iraq (19 March 2003 - 1 May 2003) * Transition of Iraq (2 May 2003 - 28 June 2004) * Iraqi Sovereignty (1 January 2009-31 August 2010) d. The OSR was established by the Secretary of the Army on 10 April 1981. The regulation states, in pertinent part, that effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. 16. According to the Awards Branch at the U.S. Army Human Resources Command, Iraq and Afghanistan are considered isolated areas where tour lengths have not been established by the Department of Defense. Soldiers who serve 11 cumulative months in a 24-month period or 9 continuous months in Iraq or Afghanistan get credit for a completed short tour. DISCUSSION AND CONCLUSIONS: 1. The applicant contends that his DD Form 214 for the period ending 6 June 2011 should be corrected to show all of his specialties and military education. 2. His DD Form 214 for the period ending 24 July 2008 shows he was awarded MOS 94E2O and 25U2O. In addition, in item 14 shows he completed: * Primary Leadership Development Course * Hazardous Material Certification * Combat Life Savers Course * Combatives Level 1 * Basic Noncommissioned Officer Course 3. On 25 July 2008, the applicant was appointed as a warrant officer. On 6 June 2011, he was discharged from active duty. His DD Form 214 shows he was awarded MOS 254A0. Item 14 shows he completed Warrant Officer Basic Course and Security and Signal Systems Support Technician Warrant Officer Basic Course. 4. The DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge. The form shows MOS's held and military education completed during the period covered by the form. Each of his DD Forms 214 correctly shows this information. There is no basis for adding MOS and military education from his enlisted service to the DD Form 214 documenting his service as a warrant officer. 5. Evidence of record shows the applicant was awarded four AAM's. His DD Form 214 should be amended to show these awards. 6. Evidence of record shows during his service in Afghanistan the applicant participated in one air assault and one campaign and he indicated he desired the ACM in lieu of the GWOTEM. Therefore, he is eligible for award of the ACM with one arrowhead and one bronze service star. His DD Form 214 should be amended to add this award. 7. Evidence of record shows during his service in Iraq the applicant participated in three campaigns. Therefore, he is eligible for award of the ICM with three bronze service stars. His DD Form 214 should be amended to show this award. 8. The applicant contends that his DD Form 214 for the period ending 6 June 2011 should show the OSR (2nd Award). His ERB shows he was deployed to Iraq from 1 March 2003 to 4 February 2004 (11 months) and his DD Form 214 for the period ending 6 June 2011 shows he was deployed to Iraq from 30 June 2009 to 30 June 2010 (12 months). His service in Afghanistan did not meet the criteria for completion of a short tour. Therefore, his DD Form 214 should amended to show the OSR (numeral 2). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. deleting from his DD Form 214 for the period ending 6 June 2011: * Army Achievement Medal (3rd Award) * Global War on Terrorism Expeditionary Medal * Iraq Campaign Medal with two bronze service stars * Overseas Service Ribbon (3rd Award) b. amending his DD Form 214 for the period ending 6 June 2011 to add: * Army Achievement Medal (4th Award) * Iraq Campaign Medal with three bronze service stars * Afghanistan Campaign Medal with one bronze service star and arrowhead * Overseas Service Ribbon (numeral 2) 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.
