DOCKET NUMBER: AR20100000329
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that he be awarded the Army Good Conduct Medal (AGCM). He also requests that his second award of the Army Commendation Medal (ARCOM) be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty).
2. The applicant states he was never awarded the AGCM and that even though he was given the second award of the ARCOM it was never added to his
DD Form 214.
3. The applicant does not provide any additional documents.
CONSIDERATION OF EVIDENCE:
1. The applicantÂ’s military records show he enlisted in the Regular Army on
12 April 2006 with 3 years of prior active service. He served as a fire support specialist in pay grade E-5.
2. On 8 April 2009, the applicant was honorably released from active duty to attend civilian school. He completed 2 years, 11 months, and 27 days of active service during this period. There is no evidence or indication of any disciplinary problems in the applicant's military records.
3. The DD Form 214 he was issued shows he was awarded the ARCOM and the Navy Good Conduct Medal (NGCM).
4. Contained in the applicant's records is an ARCOM certificate which shows the applicant was awarded the ARCOM for exceptionally meritorious service in Permanent Order Number 251-036. Also contained in the applicant's records is an ARCOM certificate which shows he was awarded the ARCOM for meritorious service in Permanent Order Number 133-001.
5. Army Regulation 600-8-22 (Military Awards) provides that the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.
DISCUSSION AND CONCLUSIONS:
1. The applicant's records contain documents which confirm he was awarded two ARCOMs. As such, it would now be appropriate to add the second ARCOM to his DD Form 214.
2. The applicant terminated his period of Regular Army service on 8 April 2009 after completing 2 years, 11 months and 27 days of active service. There is no evidence of any indiscipline in his records. He has not been previously awarded the AGCM (the NGCM is a different award). Therefore, he is entitled to the AGCM for this period of service.

He states he is also requesting all awards and decorations be added to his DD Form 214 (Certificate of Release or Discharge from Active Duty). This supports a conclusion there was no disqualification during his original qualifying period. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him the first award of the Army Good Conduct Medal for his qualifying period of honorable active duty service from 18...

He states, in effect, his DD Form 214 does not show all the awards he received and his awards were never issued to him. Therefore, it would be appropriate to award him the first award of the AGCM based on completion of a qualifying period of active Federal service and correct his DD Form 214 to show this award. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by a. awarding him the AGCM (1st Award) for the period 29...

The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Good Conduct Medal (AGCM). The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to reflect his awards of the Army Commendation Medal (ARCOM) and the Army Good Conduct Medal (AGCM). Although there are no orders awarding the applicant the AGCM in the available records, the applicant met all of the qualifications for award of the AGCM and there is no indication of any action taken by the commander at the time to disqualify him for this award. As a...

There are no orders in his service personnel records that show he was awarded the BSM, ARCOM (2nd Award), AAM (2nd Award), AGCM, or the Honduran Military Airborne Badge. Neither the applicant's DD Form 214 nor his DA Form 2-1 show the second award of the ARCOM or the AAM and the applicant's records do not contain any orders for these awards. In the absence of such evidence, there is an insufficient basis to correct his DD Form 214 to show his service in Honduras or to award him the...

The applicant states he never received the award of the AGCM after having served 4 years of active duty service with no time lost or disciplinary actions. After carefully examining the applicantÂ’s record of service, it appears that the applicant should have received the first award of the AGCM for his service from 30 October 1991 through 29 October 1994. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. awarding him...
