THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests to be awarded the Combat Infantryman Badge (CIB).

2.  The applicant states he fulfilled the requirements for the CIB, but was never awarded it.

3.  The applicant provides a DD Form 214 (Certificate of Release or Discharge from Active Duty) and a Veterans Service Officer's statement in support of this application.

CONSIDERATION OF EVIDENCE:

1.  The applicant's record shows he enlisted in the Regular Army on 26 May 2005.  It also shows he was trained in and awarded military occupational specialty 11C (Indirect Fire Infantryman).

2.  The applicant's official military personnel file contains Permanent Orders Number 144-022, dated 24 May 2007, issued by Headquarters, Multi-National Division (Baghdad), Camp Liberty, Iraq.  These orders awarded the applicant the CIB for participating in ground combat operations under enemy hostile fire to liberate Iraq in support of Operation Iraqi Freedom.

3.  On 14 September 2008, the applicant was honorably released from active duty.  Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) of the DD Form 214 he was issued at the time shows he earned the following awards during his active duty tenure:
* 
National Defense Service Medal
* Global War on Terrorism Service Medal
* Iraq Campaign Medal (ICM) with one bronze service star
* Army Service Ribbon
* Overseas Service Ribbon

4.  Item 18 (Remarks) of the applicant's DD Form 214 shows he served in Iraq from 25 October 2006 through 31 October 2007.

5.  Army Regulation 600-8-22 (Military Awards) states the ICM is awarded to members who have served in direct support of Operation Iraqi Freedom.  This regulation also states that a bronze service star is authorized for wear with this medal for participation in each credited campaign.  Approved campaigns are:

* Liberation of Iraq (19 March 2003-1 May 2003)
* Transition of Iraq (2 May 2003-28 June 2004)
* Iraqi Governance (29 June 2004-15 December 2005)
* National Resolution (16 December 2005-9 January 2007)
* Iraqi Surge (10 January 2007-31 December 2008)
* Iraqi Sovereignty (1 January 2009-date to be determined)

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention he met the requirements for the CIB has been carefully considered and found to have merit.  The applicant's record contains permanent orders that awarded him the CIB on 24 May 2007 based on his participation in ground combat operations under enemy hostile fire to liberate Iraq in support of Operation Iraqi Freedom.  Therefore, it would be appropriate to add this award to his DD Form 214.

2.  The applicant was awarded the ICM with one bronze service star; however, the evidence of record confirms that during his assignment in Iraq, participation credit was granted for the National Resolution (16 December 2005-9 January 2007) and Iraqi Surge (10 January 2007-31 December 2008) campaigns.  As a result, it would be appropriate to correct his record and DD Form 214 to show he earned the ICM with two bronze service stars.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 13 of his DD Form 214 by:

	a.  deleting the "Iraq Campaign Medal with campaign star" entry and replacing it with the entry "Iraq Campaign Medal with two bronze service stars,"

	b.  adding the Combat Infantryman Badge, and

	c.  by providing him a correction to his DD Form 214 that includes these changes.
