BOARD DATE: 25 May 2010
DOCKET NUMBER: AR20090020385
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction to his date of birth shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).
2. The applicant states the wrong date of birth of 26 November 1946 is shown, whereas his date of birth is 26 November 1944. He has not looked at his
DD Form 214 until now.
3. In support of his application, the applicant provides his birth certificate.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. His military records show he was inducted into the Army of the United States in pay grade E-1 on 16 February 1966. His DD Form 47 (Record of Induction), Item 5 (Date of Birth) shows 26 November 1944. His DA Form 20 (Enlisted Qualification Record), Item 6 (Date of Birth), shows 26 November 1944. He was released from active duty on 29 January 1968, as an overseas returnee. He was issued a DD Form 214 that shows in Item 9 (Date of Birth) his date of birth as 26 November 1946.
3. He submitted a Goshen Department of Health certificate, issued on 19 December 1944, that certified a male registrant with the same name as his was born on 26 November 1944 in Goshen, Indiana.
DISCUSSION AND CONCLUSIONS:
1. The applicant's contention that his date of birth is incorrect on his DD Form 214 was carefully reviewed and found to have merit.
2. The evidence of record confirms that the entry on his DD Form 214 appears to be due to a typographical error. Therefore, his DD Form 214 should be corrected to show his proper date of birth as 26 November 1944.
BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing his date of birth as 26 November 1944 in Item 9 of his DD Form 214.

A DD Form 47 (Record of Induction) shows his DOB with the year 1944. Item 9 (Date of Birth) of his DD Form 214 shows his DOB with the year 1944. There is sufficient evidence to show the year shown for his DOB on his DD Form 214 is incorrect.

Application for correction of military records (with supporting documents provided, if any). Item 5 (DOB) of his DD Form 47 (Induction Record) and various other documents in his official military personnel file (OMPF) list his DOB as 2 October 1946. He did not use the DOB that he now requests to be documented in his records.

The applicant requests correction of his military records to show his date of birth (DOB) as 28 May 1927 instead of 17 November 1926. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. Although the birth certificate provided by the applicant shows his DOB as 28 May 1927, the evidence of...

A second WD AGO Form 53-55 shows he enlisted on 2 November 1945 and he was separated from active duty on 26 November 1946 for a total of 1 year and 25 days of active duty service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Regardless of the entries shown on his DD Form 214, without documentation showing he was drafted, inducted, or entered active duty prior to 9 April 1945, there is insufficient evidence...

Application for correction of military records (with supporting documents provided, if any). The applicant requests, in two separate applications, correction of his WD AGO Form 53-55 (Enlisted Record and Report of Separation) to show award of the Belgian Fourragere and his last name as H-----c--. Army Regulation 600-8-22 (Military Awards) provides for award of the Belgian Fourragere.

The applicant requests correction of his WD AGO Form 53-55 (Enlisted Record and Report of Separation-Honorable Service) to show he was honorably separated on 19 November 1952 instead of 2 April 1946. The WD AGO Form 53-55 is prepared for all enlisted personnel separated from the service due to discharge, release from active duty or transfer to a Reserve Component, or retired. The applicant contends that the date of separation shown on his WD AGO Form 53-55 should be corrected to show 19...

A review of his record shows that all documents bearing a DOB show the date 28 September 1946. The evidence of record shows the applicant was inducted on 10 November 1965, but his DD Form 214 shows he was inducted on 10 November 1967. He is entitled to correction of his DD Form 214 to show the correct year of his induction.
ARMY | BCMR | CY2013 | 20130012246
The applicant requests correction of his records to show his correct date of birth (DOB) and social security number (SSN). The applicant's DD Form 47 (Record of Induction) shows in item 5 (DOB): "18 Nov 1946." The evidence of record shows the U.S. Army was not using the SSN as identification at the time the applicant entered active duty.
ARMY | BCMR | CY2005 | 20050000690C070206
The applicant requests that his records be corrected to show his correct date of discharge, date of entry into active service, and date of birth (DOB). It is reasonable to assume that if the applicant's date of discharge was 26 July 1953 and he served 3 years on active duty on this enlistment, that his date of entry was 27 July 1950. At the time of the creation of the applicant's military records, the applicant was using 28 August 1926 as his date of birth.

Application for correction of military records (with supporting documents provided, if any). The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his date of birth (DOB) as 1 September 1944 versus 26 August 1944. The evidence of record shows he listed either 25 August 1944 or 26 August 1944 as his DOB throughout the entire period of his active military service.
