THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Meritorious Service Medal (MSM).

2.  The applicant states:

* he received the MSM
* the award was pending final signatures on his retirement date
* the award was presented on 15 August 2009

3.  The applicant provides:

* orders for the MSM
* DA Form 638 (Recommendation for Award)
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 14 April 1987.  He served as a motor transport operator and remained on active duty through continuous reenlistments until he retired by reason of sufficient service for retirement in the rank of staff sergeant on 30 April 2009.

2.  Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 does not show the MSM as an authorized award.

3.  Evidence of record shows Headquarters, III Corps, Fort Hood, TX, Permanent Order A-167-12, dated 16 June 2009, awarded the applicant the MSM for the period 1 May 1999 to 30 April 2009.

DISCUSSION AND CONCLUSIONS:

Orders show the applicant received the MSM after his retirement on 30 April 2009.  Therefore, his DD Form 214 should be corrected to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 13 of his DD Form 214 for the period ending 30 April 2009 the Meritorious Service Medal.
