THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that item 12a (Date Entered Active Duty (AD) This Period) and item 12c (Net Active Service This Period) of his 
DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected.

2.  The applicant states, in effect, that item 12a of his DD Form 214 should be corrected to show he entered active duty on 18 October 2000, and as a result, the total active duty service listed in item 12c should be corrected accordingly.  

3.  The applicant provides his DD Form 214, DD Form 1966 (Record of Military Processing), and DD Form 4 (Enlistment/Reenlistment Document) in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s Official Military Personnel File (OMPF) includes a DD Form 4 and DD Form 1966 prepared on him during his enlistment processing.  These documents show he enlisted in the Regular Army (RA) for a period of 3 years and entered active duty on 18 October 2000.

2.  The applicant's DA Form 2-1 (Personnel Qualification Record) confirms he entered active duty on 18 October 2000.  

3.  On 28 December 2002, the applicant was discharged.

4.  The DD Form 214 issued to the applicant on 28 December 2001, the date of his discharge, contains an entry in item 12a that shows he entered active duty on 18 January 2001.  Item 12b (Separation Date This Period) contains an entry showing he was discharged on 28 December 2002, and item 12c contains an entry indicating he completed a total of 1 year, 11 months, and 11 days of active military service during the period covered by the DD Form 214.  

5.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  Chapter 2 contains item-by-item instructions for preparing the DD Form 214.  The instructions for completing Item 12a states to enter the beginning date of the continuous period of active duty for issuance of the DD Form 214, for which a DD Form 214 was not previously issued.  The instructions for item 12c state to enter the amount of service completed during the period covered by the DD Form 214, which is computing by subtracting item 12a from 12b.

DISCUSSION AND CONCLUSIONS:

1.  The applicant’s contention that items 12a and 12c of his DD Form 214 should be corrected was carefully considered and found to have merit.

2.  The evidence of record confirms that the applicant entered active duty on 18 October 2000, as evidenced by his enlistment contract.  Accordingly the entry in item 12a of his DD Form 214 should be corrected to reflect this entry date.  In addition, based on his entry on active duty on 18 October 2000 and his separation date of 28 December 2002, item 12c should be corrected to show he completed 2 years, 2 months, and 11 days of active service during the period covered by the DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 as follows:

	a.  deleting the current entry from Item 12a and adding "2000 10 18”; 

	b.  deleting the current entry from Item 12c and adding "0002 02 11”; and 

	c.  issuing him a document that reflects these changes.
