THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction to item 12d (Total Prior Active Service) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 30 May 2009.

2.  The applicant states item 12d of this DD Form 214 incorrectly shows he served 22 years of prior active duty.  He contends it must be a typographical error and it should be 5 years and 7 months.

3.  The applicant provides copies of DD Forms 214 for the periods ending 12 March 1987 and 30 May 2009 in support of his application.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 19 October 1982, he served as an infantryman, and he was released from active duty on 12 March 1987.

2.  Item 12c (Net Active Service This Period) of the applicant's DD Form 214 for the period ending 12 March 1987 shows he completed 4 years, 4 months, and 24 days of net active service.

3.  The applicant enlisted in the U.S. Army Reserve on 29 August 1988.  He was ordered to active duty on 1 June 2005 in support of Operation Enduring Freedom.  On 30 May 2009, he was released from active duty.

4.  Item 12d of the applicant's DD Form 214 for the period ending 30 May 2009 shows the entry "0022  07  12" [22 years, 7 months, and 12 days].  This DD Form 214 shows the applicant was separated from the service on temporary records and a Soldier's affidavit.
 
5.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states that for item 12 (Record of Service), use extreme care in completing this block since post-service benefits, final pay, retirement credit, and so forth are based on the information.  It further states that for item 12d, enter total amount of prior active military service less lost time, if any, from previously issued DD Forms 214.  If not applicable, enter "00  00  00."

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that item 12d of his DD Form 214 for the period ending 30 May 2009 incorrectly shows he served 22 years of active duty and it should be 5 years and 7 months.

2.  Item 12d of the applicant's DD Form 214 for the period ending 30 May 2009 shows the entry "0022  07  12."  However, the evidence of record shows he completed 4 years, 4 months, and 24 days of prior active duty.  Therefore, it would be appropriate to correct item 12d of the applicant's DD Form 214 for the period ending 30 May 2009 to show this service.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting the entry from item 12d of his DD Form 214 for the period ending 30 May 2009 and

	b.  adding the entry "0004  04  24" to item 12d of this DD Form 214.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to amending item 12d of his DD Form 214 for the period ending 30 May 2009 to show he had 5 years and 7 months of prior active service.
