THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of her records to show her deployment to Iraq.

2.  The applicant states she was in Iraq from 15 September 2007 to 7 January 2008.

3.  The applicant provides a copy of her deployment orders, dated 12 July 2007, and her DD Form 1351-2 (Travel Voucher or Subvoucher) in support of her application. 

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army (RA) on 4 August 2005.

2.  Headquarters, U.S. Army Medical Department Center and School, Fort Sam Houston, TX, Orders 193-1101, dated 12 July 2007, show the applicant’s unit was deployed to Iraq with an effective date of 5 September 2007 for a period of 455 days.

3.  The applicant provided a DD Form 1351-2 which shows she departed from San Antonio, TX on 14 September 2007 and arrived in Kuwait on 15 September 2007.  This voucher also shows she departed Kuwait and she arrived in Iraq on 22 September 2007 and she returned to Kuwait on 3 January 2008.  She remained in Kuwait until 7 January 2008.

4.  The applicant was discharged on 29 January 2008.  Item 12f (Foreign Service) of her DD Form 214 does not show any foreign service.

5.  Item 18 (Remarks) of her DD Form 214 does not show she served in Iraq in support of Operation Iraqi Freedom.

6.  In an email, dated 4 December 2009, the Defense Finance and Accounting Service (DFAS) indicated the applicant received hostile fire pay (HFP)/imminent danger pay (IDP) and  Combat Zone Tax Exemption (CZTE) from 15 September 2007 through 7 January 2008 for service in Kuwait.

7.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states that for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in item 18.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that she was in Iraq from 15 September 2007 to 7 January 2008.  There is sufficient evidence on which to grant the relief requested.

2.  The applicant’s DD Form 1351-2 shows her deployment to Kuwait/Iraq from 15 September 2007 through 7 January 2008.

3.  The applicant's military pay records at DFAS show she received IDP/HFP and CZTE from 15 September 2007 through 7 January 2008 for service in Kuwait.

4.  The applicant's military pay records combined with her DD Form 1351-2 are accepted as sufficient evidence as a basis to amend item 18 of her DD Form 214 to show the entry "SERVICE IN KUWAIT/IRAQ FROM 20070915-20080107." 

5.  It would also be appropriate to amend item 12f of the applicant’sDD Form 214 to reflect 3 months and 23 days of foreign service.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting from item 12f of her DD Form 214 the entry "0000  00  00" and replacing it with the entry "0000 03 23"; and

	b.  adding to item 18 of her DD Form 214 the entry "SERVICE IN KUWAIT/IRAQ FROM 20070915-20080107."
