THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty), issued on 26 May 2007, be corrected to show award of the Bronze Star Medal (BSM), Meritorious Service Medal (MSM) 
(3rd Award), Army Commendation Medal (ARCOM) (3rd Award), and the Meritorious Honor Award.

2.  The applicant states that these awards were missing from his DD Form 214. He requests that his records be reviewed to ensure that all awards and decorations are listed on his DD Form 214.   

3.  The applicant provides a copy of his DD Form 214, BSM, MSM, and ARCOM certificates and orders.  He also provides a Nomination and certificate for the Meritorious Honor Award.

CONSIDERATION OF EVIDENCE:

1.  The applicant’s records show he was commissioned as an officer in the Regular Army on 27 May 1981.  He was subsequently appointed as a captain in the United States Army Reserve (USAR).  On 31 January 2002, he was transferred to the USAR Control Group (Retired).

2.  Item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant's DD Form 214 shows he was awarded the following awards:  Pathfinder Badge, Ranger Tab, Meritorious Service Medal, Army Commendation Medal (2nd Award), Army Achievement Medal, Army Reserve Components Achievement Medal, National Defense Service Medal (2nd Award), Global War on Terrorism Service Medal, Iraq Campaign Medal, Army Service Ribbon, Overseas Service Ribbon 
(2nd Award), Armed Forces Reserve Medal with M Device, Multinational Force and Observers Medal, Expert Infantryman Badge, Parachutist Badge, and German Armed Forces Parachutist Badge - Bronze.

3.  Permanent Orders Number 019-012, dated 19 January 2007, and a certificate show the applicant was awarded the BSM for meritorious service during the period 26 April 2006 to 25 April 2007.

4.  Permanent Orders 15-11, dated 19 October 1992, and a certificate show the applicant was awarded the MSM for meritorious service during the 29 May 1989 to 1 September 1992.  Permanent Orders 022-43, dated 22 January 2004, and a certificate show the applicant was awarded the MSM for meritorious service during the period 25 October 2000 to 31 January 2002.  Permanent Orders 
78-25, dated 28 June 1989, and a certificate also show the applicant was awarded the MSM for meritorious service during the period August 1985 to April 1989.

5.  Permanent Orders 27-216, dated 7 February 1985, and a certificate show the applicant was awarded the ARCOM for meritorious service during the period 
11 September 1984 to 17 December 1984.  Permanent Orders 10-54, dated
18 August 1993, and a certificate show the applicant was awarded the ARCOM for meritorious achievement during the period 25 May 1993 to 12 June 1993.  Permanent Orders 19-09, dated 21 August 1994, and a certificate also show the applicant was awarded the ARCOM for meritorious achievement during the period 4 October 1993 to 15 June 1994. 

6.  The Department of State Certificate, dated March 2007, shows the applicant was awarded the Meritorious Honor Award for providing outstanding leadership and operational support to the Kirkuk Provincial Reconstruction Team Governance Team, Baghdad Iraq. 

7.  Army Regulation 635-5 (Separation Documents), paragraph 2-4(13), states to list all decorations, medals, badges, citations, and campaign ribbons awarded or authorized for all periods of service in the priority sequence specified in Army Regulation 600-8-22. Each entry will be verified by the Soldier’s records. 




8.  Army Regulation 600-8-22 (Military Awards), paragraph 1-41 states that the order and precedence for awards and decorations when worn are as follows:

   a.  Decorations, the Good Conduct Medal, service medals, and service ribbons are ranked in the following order of precedence when worn or displayed:
      
   (1) U.S. military decorations.
   (2) U.S. nonmilitary decorations.
   (3) Prisoner of War Medal.
   (4) Good Conduct Medal.
   (5) U.S. Army Reserve Components Achievement Medal.
   (6) U.S. service medals and service ribbons.
   (7) U.S. Merchant Marine decorations.
   (8) Foreign decorations (excluding service medals and ribbons).
   (9) Non-U.S. service medals and ribbons.
   
   b.  The order of precedence for wear within the various classes of medals
and service ribbons is stated in Army Regulation 670–1 (Wear and Appearance of Army Uniforms and Insignia), paragraph 29–6c.  This chapter explains the Department of Defense (DOD) policies and procedures and states that U.S. 
non-military decorations authorized for wear on Army uniforms are listed in their order of precedence.  Other U.S. non-military decorations that were issued by Federal agencies will be worn based upon their date of receipt.

DISCUSSION AND CONCLUSIONS:

1.  Permanent Orders Number 019-012 awarded the applicant the BSM.  Therefore, his DD Form 214 should be corrected to show this award.

2.  Permanent Orders 15-11, 022-43, and 78-25 awarded the applicant the MSM. His DD Form 214 shows only one award of the MSM.  Therefore, his 
DD Form 214 should be corrected to show three awards of the MSM. 

3.  Permanent Orders 27-216, 10-54, and 19-09 awarded the applicant the ARCOM.  His DD Form 214 shows two awards of the ARCOM.  Therefore, his DD Form 214 should be corrected to show three awards of the ARCOM.

4.  Evidence of record shows that the applicant was awarded the U.S. Department of State Meritorious Honor Award which is a U.S. non-military award. Further, Army Regulation 600-8-22 lists the order of precedence of awards and decorations including U.S. non-military decorations which are worn immediately following U.S. military decorations.  Therefore, the applicant's record should be corrected to show award of the U.S. Department of State Meritorious Honor Award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 13 of his 26 May 2007 DD Form 214 the following awards:

	a.  Bronze Star Medal;

	b.  Meritorious Service Medal (3rd Award);

   c.  Army Commendation Medal (3rd Award); and

	d.  the Meritorious Honor Award.
