IN THE CASE OF:
BOARD DATE: 24 November 2009
DOCKET NUMBER: AR20090011606
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his service in item 25 (Disability Retirement Section 1208) of his AGPZ Form 977 (Data for Retired Pay) and for this corrected form to be sent to the Defense Finance and Accounting Service (DFAS).
2. The applicant states he has 10 years, 10 months, and 20 days of active service but DFAS shows only 10 months and 20 days and therefore he is not being paid the correct amount of Combat Related Special Compensation (CRSC).
3. The applicant provides copies of three DD Forms 214 (Armed Forces of the United States Report of Transfer or Discharge) in support of this application.
CONSIDERATION OF EVIDENCE:
1. The applicant's military records show he enlisted in the Regular Army on 26 June 1961. He served continuously through reenlistments and was promoted to pay grade E-7.
2. The applicant was honorably retired on 15 May 1972 for permanent disability after completing 10 years, 10 months, and 20 days of creditable active service. He was placed on the retired list effective 16 May 1972 with a 70 percent disability rating.
3. An AGPZ Form 977 contained in the applicant's records shows 0 years, 10 months, and 20 days in item 25. This document further shows 10 years, 10 months, and 20 days in item 28 (Basic Pay - Section 202 Act of 12 October 1949).
DISCUSSION AND CONCLUSIONS:
1. The applicant's records show he served 10 years, 10 months, and 20 days of creditable active service. It appears that a typographical error was made when completing item 25 of his AGPZ Form 977. Therefore, he is entitled to have item 25 of this form corrected to show 10 years, 10 months, and 20 days of creditable active service.
2. In view of the foregoing, the applicant is entitled to have his records corrected as shown below.
