		IN THE CASE OF:

		BOARD DATE: 29 October 2009

		DOCKET NUMBER: AR20090008511

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) by removing the Combat Medical Badge (CMB).

2. The applicant states, in effect, that he was never a medic and that he was not officially awarded the CMB.

3. The applicant provides a DD Form 214 for the period ending 31 January 2008 in support of this application.

CONSIDERATION OF EVIDENCE:

1. The applicant's military records show he enlisted in the Army National Guard on 30 April 1991. He was awarded several military occupational specialties (MOSs). However, his available record failed to show he was awarded or held a medical MOS. Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 for the period 30 September 2006 to 31 January 2008 contains the entry "Combat Medical Badge-1."

2. A search of the applicant's interactive Personnel Electronic Records Management System (iPERMS) also failed to reveal any evidence that he held a medical MOS or that he was awarded the CMB.

3. Army Regulation 600-8-22 provides that the CMB is awarded to medical department personnel (colonels and below) who are assigned or attached to a medical unit of company or smaller size that is organic to an infantry unit of brigade, regimental or smaller size which is engaged in active ground combat. Battle participation credit is not sufficient; the infantry unit must have been in contact with the enemy.

4. Army Regulation 635-5 (Separation Documents) is a synopsis of the Soldier's most recent period of continuous active duty service. It provides a brief, clear-cut record of active service at the time of release from active duty or discharge.

DISCUSSION AND CONCLUSIONS:

1. There is no evidence to show the applicant held a medical MOS or that he was assigned or attached to a medical unit of company or smaller size that was organic to an infantry unit of brigade, regimental or smaller size when the unit engaged in active ground combat.

2. There is also no evidence available to show the applicant was officially awarded the CMB. Therefore, it would be appropriate to delete the "Combat Medical Badge-1" from item 13 of his DD Form 214 that was issued on 31 January 2008.

BOARD VOTE:

___X___ ___X____ ___X____ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all State Army National Guard and Department of the Army records of the individual concerned be corrected by deleting the "Combat Medical Badge-1" from his

records to include item 13 of his DD Form 214 that was issued on 31 January 2008.

His record is void of any documents showing he served as a combat medic with a qualifying infantry unit or that he was recommended for or awarded the CMB or CIB by proper authority while serving in SWA. The applicant's contention he qualified for the CMB and CIB based on his combat service in SWA in support of Operation Desert Storm has been carefully considered. The evidence of record shows the applicant held a medical MOS and not an infantry MOS.

Specifically, counsel presents the following arguments: a. the Board erred in denying the applicant his CMB based on a determination that he was not assigned or attached to a medical unit of company or smaller size that was organic to an infantry unit of brigade, regiment, or smaller size and that the word “or” is a mutually exclusive criterion that does not require the unit of attachment or assignment to be organic to an infantry unit; b. the medical officer’s statement and evidence that...

The applicant requests award of the Combat Medical Badge and the Bronze Star Medal based on award of the Combat Medical Badge. The sole criteria that qualify medical personnel for award of the CMB is to be assigned or attached to an infantry unit engaged in active ground combat. The evidence of record shows the applicant served as a medical specialist during his service in WW II.

The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his award of the Combat Medical Badge (CMB). He completed 4 years of active service with no lost time. Although he did not provide the accompanying orders and his records do not contain such orders, the evidence of record shows he held a medical MOS, twice served in combat, and he was assigned to a medical unit of company or smaller size that is organic to an infantry unit of...

It states, in pertinent part, that a bronze service star is authorized with this award for each RVN campaign a member is credited with participating in. However, there are no orders, or other documents on file that show he was ever recommended for, or awarded either the CIB or CMB while he was serving on active duty. The evidence of record confirms the applicant’s combat service in the RVN; however, combat service alone does not support award of the CMB or CIB.
