		IN THE CASE OF:

		BOARD DATE: 27 August 2009

		DOCKET NUMBER: AR20090005211

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, that his records be corrected to show that he elected the Survivor Benefit Plan (SBP) in a timely manner.

2. The applicant states that he did not receive a DD Form 2656 (Data for Payment of Retired Personnel) prior to his retirement date. Now the Defense Finance and Accounting Service (DFAS) will not accept his "invalid" DD Form 2656 dated 24 March 2009.

3. The applicant provides the orders placing him on the Temporary Disability Retired List (TDRL) effective 12 January 2008; a memorandum to him dated 7 December 2007 which informs him that prior to activation of his retired pay account, he must complete a DD Form 2656 and send it to DFAS; and a DD Form 2656 dated 24 March 2009.

CONSIDERATION OF EVIDENCE:

1. The applicant's military records show that he enlisted in the Army National Guard (ARNG) on 19 November 1999 with 1 year, 6 months, and 16 days of prior Reserve Component service and 2 years, 3 months, and 22 days of prior active service.

2. The applicant served continuously in the ARNG and was promoted to pay grade E-7.

3. On 12 January 2008 the applicant was placed on the TDRL.

4. In the processing of this case, the Board's staff contacted the DFAS which provided the Board's staff a DD Form 2656 dated 28 September 2008 in which the applicant elected not to participate in the SBP. His wife signed this form on the same date concurring with the applicant's election. This form is witnessed and notarized.

5. Public Law 92-425, the SBP, enacted 21 September 1972, provided that military members on active duty could elect to have their retired pay reduced to provide for an annuity after death to surviving dependents. Changes in SBP options are not authorized except in specific instances, or authorized by law.

DISCUSSION AND CONCLUSIONS:

1. Contrary to the applicant's contention, he had submitted a DD Form 2656 dated 28 September 2008 which was accepted by DFAS. This was dated and received by the DFAS well prior to the DD Form 2656 submitted by the applicant which is dated 24 March 2009.

2. However, the applicant declined SBP in the DD Form 2656 dated 28 September 2008 and his wife concurred with the declination.

3. Since a legal SBP election was made declining SBP, there is no basis for changing the applicant's records to show he elected SBP coverage.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

___X____ ____X__ ___X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The applicant states that on or about 21 July 2008 he completed a DD Form 2656 (Data for Payment of Retired Personnel) at the Army Retirement Services Office (RSO) at Fort Irwin, CA declining enrollment in the SBP. The RSO sent his wife a "Spouse Concurrence Letter Decline SBP," dated 21 July 2008, and a Spouse SBP Election Concurrence Statement via FedEx. The letter to the applicant's wife would not have been sent if he had not already completed a DD Form 2656.

DPSIAR indicates that since there is a possibility of Air Force error in this case, they recommend the applicant’s record be corrected to reflect he declined SBP coverage effective 21 June 2008. He wants his former spouse dropped from his SBP and is willing to pay for his son’s coverage since 30 June 2009. The following documentary evidence for AFBCMR Docket Number BC-2012- 00286 was considered: Exhibit A. DD Form 149, dated 10 Feb 12, w/atchs.

On 14 January 2004, he completed a DD Form 2656-5 (Reserve Component Survivor Benefit Plan (RCSBP) Election Certificate), electing to provide full (spouse only) SBP coverage under option C (Immediate Annuity). Because the evidence clearly shows he intended to decline SBP with his wife's concurrence, it would be equitable to correct his DD Form 2656, to show the applicant, witness, applicant's spouse, and the notary all signed and dated the form on 16 September 2009, declining SBP with a...

The applicant's wife relied on counseling from Department of Defense (DOD) personnel when she signed the DD Form 2656 pursuant to the applicant's power of attorney. Counsel states the applicant and his wife were incorrectly counseled concerning the durable power of attorney and their SBP election. Over a month before his date of retirement the applicant and his wife submitted his DD Form 2656 electing to decline to participate in SBP.

On 7 August 2008, the applicant completed a DD Form 2656 and he elected not to participate in SBP. An election to decline to participate in the SBP must be made prior to the effective date of retirement or else coverage automatically defaults to full spouse (or child only coverage, if applicable) coverage. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. amending his DD Form 2656 to show he and his spouse signed the...

In section IX (SBP Election) of this form, the applicant checked that he elected coverage for spouse only, based on full gross pay. There is no evidence of record and he does not provide any evidence to show that he completed a new DD Form 2656 prior to his retirement date. DFAS indicated the applicant requested termination of his SBP coverage in October 2009.

The Defense Finance and Accounting Service (DFAS) provided a DD Form 2656 (Data for Payment of Retired Personnel) signed by the applicant on 6 April 2011. The DD Form 2656 provided by DFAS clearly shows the applicant elected SBP spouse only coverage based on the full amount of his retirement pay.

On 16 October 2007, DFAS informed this agency by email that the applicant used the wrong DD Form 2656 and signed it on 15 April 2007 after having been placed on the TDRL. The applicant alleges that she does not remember electing SBP; however, the evidence shows that she completed an SBP Election Certificate, DD Form 2656-5 (the incorrect form for a member being medically retired), on 15 April 2005, after placement on the TDRL.
