		IN THE CASE OF:

		BOARD DATE:	       16 JULY 2009

		DOCKET NUMBER:  AR20090002782

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests, in effect, that the date entered active duty this period on his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show 17 March 2005.

2. The applicant states, in effect, he entered active duty in 2005 and he served in Iraq from 26 June 2005 to 16 June 2006 and that according to the entry date listed on his DD Form 214 he was already serving in Iraq prior to his entry date.

3. The applicant provides a copy of his DD Form 214 in support of his application.

CONSIDERATION OF EVIDENCE:

1. A DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) shows the applicant enlisted in the Army National Guard (ARNG) on 23 January 2004.

2. Department of Defense, Military Entrance Processing Station, Nashville, TN Orders 4023-4, dated 23 January 2004, ordered the applicant to initial active duty for training (IADT) with a report date of 11 August 2004 to Fort Knox, KY.

3. Department of the Army, Headquarters, United States Army Armor Center and Fort Knox, KY Orders 238-0514, dated 25 August 2004, released the applicant from Fort Knox, KY and further assigned him to Aberdeen Proving Ground, Maryland to complete advanced individual training in military occupational specialty (MOS) 44B (Metal Worker), effective 22 October 2004. No separation orders are available.

4. While Tennessee Army National Guard (TNARNG) Orders 068178, dated 9 March 2005, are not available, it appears that these orders directed the applicant to report for active duty on or about 17 March 2005 in support of Operation Iraqi Freedom.

5. A memorandum, dated 25 July 2006, show the TNARNG awarded the applicant the TNARNG War Service Ribbon for the period of service from 17 March 2005 through 25 June 2006 for meritorious service in combat while deployed to Operation Iraqi Freedom from 17 March 2005 through 25 June 2006.

6. Department of the Army and the Air Force, Joint Force Headquarters, TNARNG, Orders 179-196, dated 28 June 2006, amended TNARNG Orders 068178, dated 9 March 2005, to change the applicant’s date of release to
10 July 2006.

7. A DD Form 214, issued on 10 July 2006, shows the following pertinent information:

	a.  block 12a, date entered active duty this period, shows 17 March 2006;

	b.  block 12b, separation date this period, shows 10 July 2006;

	c. block 12c, net active service this period, shows 1 year, 3 months, and
24 days; and

	d. block 18 (Remarks), shows in part, service in Kuwait/Iraq from 26 June 2005 to 16 June 2006.

DISCUSSION AND CONCLUSIONS:

1. The applicant contends the date entered active duty this period on his DD Form 214 should be changed to show the year 2005.

2. The applicant’s DD Form 214 appears to contain a typographical error in block 12a. The available evidence clearly shows the applicant was already on active duty and serving in Iraq prior to the date listed in item 12a of his DD Form 214.

3. Furthermore, the applicant received a TNARNG award for a period of active duty from 17 March 2005 through 10 July 2006, a period of 1 year, 3 months, and 24 days, which is the same duration reported at block 12c on the DD Form 214.

4. Therefore, it is appropriate to correct the applicant’s DD Form 214, block 12a, to show he entered active duty this period on 17 March 2005.

BOARD DETERMINATION/RECOMMENDATION:

As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the entry in block 12a of his DD Form 214 for the period ending 10 July 2006 and adding the entry 17 March 2005.
