THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, that the orders awarding and revoking the Joint Service Commendation Medal (Military Personnel Awards Order Number 2007-079) be removed from his permanent record.

2.  The applicant states that the award order for a Joint Service Commendation Medal was prepared in anticipation of his departure under permanent change of station (PCS) orders.  He did not PCS, but the recommendation for the award was processed.

3.  The applicant provides, in support of his application, copies of a 2 May 2007 Joint Service Commendation Medal certificate, a 24 May 2007 Defense Information Systems Agency awards announcement, an undated Interoffice Memorandum requesting revocation of the Joint Service Commendation Medal, and Defense Information Systems Agency Military Personnel Awards Order Number 2008-074, dated 21 April 2008.

CONSIDERATION OF EVIDENCE:

1.  The applicant, a career staff sergeant, was assigned duty with the Defense Information Systems Agency on 21 April 2003.

2.  In anticipation of the applicant's pending PCS, on or about 2 April 2007, a recommendation for award of the Joint Service Commendation Medal was prepared and processed.

3.  At an undocumented point the applicant's PSC orders were cancelled.

4.  On 24 May 2007, the Defense Information Systems Agency announced the award of the Joint Service Commendation Medal to four personnel including the applicant.  The period covered by the award is 21 April 2003 to 2 April 2007 and was based on his meritorious service and projected PCS on 2 April 2007.

5.  The Joint Service Commendation Medal certificate shows a date of award of 2 May 2007.

6.  An undated Interoffice Memorandum was prepared requesting revocation of the Joint Service Commendation Medal.  The justification for revocation was that the member's projected PCS was cancelled.

7.  On 21 April 2008, Defense Information Systems Agency, Military Personnel Awards Order Number 2008-074, revoked the award of the Joint Service Commendation Medal for the period 21 April 2003 through 2 April 2007.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's command awarded the applicant the Joint Service Commendation Medal in anticipation of his departure from the command on or about 2 April 2007.

2.  When the applicant's PCS orders were cancelled, the terminal date and reason for the award were no longer valid.  His command properly requested that the award be revoked, which was completed on 21 April 2008.

3.  While the retention of the award announcement and the revocation in the applicant's record is not an error, it does create a potential for misinterpretation.

4.  Therefore, as a matter of equity, it is appropriate to direct that all references to the award of and revocation of the 2 April 2007 Joint Service Commendation Medal be purged from the applicant's official records, to include but not limited to the award and revocation orders.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by purging his records of all reference to the award and revocation of the 2 April 2007 Joint Service Commendation Medal.

Evidence of record also shows that the ARCOM, 1OLC was never presented to the applicant, thus negating the reason for filing the DA Form 638 in her OMPF.
