THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the Afghanistan Campaign Medal with one bronze service star be entered on his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 11 June 2006.  He also requests the Ten-year device (a bronze hourglass) be shown on his Armed Forces Reserve Medal.

2.  The applicant states, in effect, these awards were not included on his latest DD Form 214.

3.  The applicant provides, in support of his application, copies of his DD Form 214 with a separation date of 11 June 2006; his orders to active duty; his unit's orders to Afghanistan; his orders for his release from active duty; 20 pages from his military personnel records; and Military Personnel (MILPER) Message Number 08-123, issued 30 April 2008.

CONSIDERATION OF EVIDENCE:

1.  The applicant initially enlisted in the Texas Army National Guard on 27 March 1997 and continues to serve in that status.

2.  On 3 March 2005, the applicant was ordered to active duty with his unit to report 10 March 2005 for a period of 545 days for OPERATION ENDURING FREEDOM.

3.  On 3 May 2005, the applicant's unit was ordered to Afghanistan and as further directed effective 7 May 2005.

4.  On 11 June 2006, the applicant was honorably released from active duty, not by reason of physical disability and transferred to his home station.  He had completed 1 year, 3 months, and 5 days of creditable active service this period.

5.  Item 13 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of the applicant’s DD Form 214 does not show the Afghanistan Campaign Medal.   Item 13 does show he was awarded the Armed Forces Reserve Medal with "M" [mobilization] Device.

6.  Item 18 (Remarks) of the applicant's DD Form 214 includes the entry "Service in Afghanistan 20050507 - 20060507" (7 May 2005 - 7 May 2006).

7.  On 21 June 2006, the applicant's orders to active duty were modified to reflect the period of active duty to be from 7 March 2005 to 11 June 2006.
8.  Army Regulation 600-8-22 (Military Awards) states, in pertinent part, that individuals authorized the Afghanistan Campaign Medal must have served in direct support of Operation ENDURING FREEDOM (OEF).  The area of eligibility encompasses all land area of the country of Afghanistan and all air spaces above the land. The Afghanistan Campaign Medal period of eligibility is on or after 24 October 2001 to a future date to be determined by the Secretary of Defense or the cessation of OEF. Service members must have been assigned, attached, or mobilized to units operating in the area of eligibility for 30 consecutive days or for 60 non-consecutive days or meet one of the following criteria: (1) be engaged in combat during an armed engagement, regardless of the time in the area of eligibility while participating in an operation or on official duties; (2) is wounded or injured and requires medical evacuation from the area of eligibility; or (3) while participating as a regularly assigned air crewmember flying sorties into, out of, within or over the area of eligibility in direct support of the military operations; each day of operations counts as one day of eligibility. 
9.  MILPER Message Number 08-123, issued 30 April 2008, provided guidance on the criteria, applicability, and standards on awarding and wear of service stars on the Afghanistan Campaign Medal.  The message provides that a bronze service star shall be worn on the suspension and campaign ribbon of the Afghanistan Campaign Medal for one or more days of participation in each designated campaign phase.  Approved designated Afghanistan Campaign Medal campaign phases and inclusive periods are LIBERATION OF 
AFGHANISTAN (11 September 2001 – 30 November 2001), CONSOLIDATION I (1 December 2001 – 30 September 2006), and CONSOLIDATION II (1 October 2006 – date to be determined). 
10.  Army Regulation 600-8-22 provides for the authorization of a Ten-year device  to be worn on the Armed Forces Reserve Medal to denote each 10-year period in a Reserve component.  Upon completion of the first 10-year period a bronze hourglass will be awarded to be worn on the Armed Forces Reserve Medal.
DISCUSSION AND CONCLUSIONS:

1.  Orders provided by the applicant and contained in his Official Military Personnel File and the entry in item 18 of his DD Form 214 show that he was assigned, attached, or mobilized to a unit operating in the area of eligibility for the Afghanistan Campaign Medal for more than 30 consecutive days.  Therefore, he is authorized the Afghanistan Campaign Medal.

2.  Based on the dates the applicant served in Afghanistan he participated in the CONSOLIDATION I campaign.  Therefore, he is authorized one bronze service star to be worn on his Afghanistan Campaign Medal.

3.  Although the applicant could be authorized a Ten-year device on his Armed Forces Reserve Medal at this time, on the date of his release from active duty  he had not completed his first 10-year period in a Reserve component.  Therefore, it is not appropriate to include this award on his DD Form 214 with a separation date of 11 June 2006.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 13 of his DD Form 214 with a separation date of 11 June 2006 to show he is authorized the Afghanistan Campaign Medal with one bronze service star.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to a Ten-year device (a bronze hourglass).
