IN THE CASE OF:
BOARD DATE: 23 January 2009
DOCKET NUMBER: AR20090000134
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
CONSIDERATION OF ADDITIONAL EVIDENCE:
17. On 7 January 2009, new information was received from the National Guard Bureau in regard to the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080013766, dated 30 October 2008.
18. The evidence submitted consists of a copy of the applicant's diploma from the United States Army Warrant Officer Career Center, which shows he graduated from the Warrant Officer Candidate School, Class 06-19 on 25 October 2006.
ADDITIONAL DISCUSSION AND CONCLUSIONS:
5. At the time of the decision of the ABCMR in Docket Number AR20080013766, dated 30 October 2008, it was the intent of the ABCMR to make the applicants record as administratively correct as it should properly have been at the time.
6. The ABCMR's decision in Docket Number AR20080013766 erroneously adjusted the applicant's permanent Federal recognition initial appointment date to 24 May 2006. Docket Number AR20080013766 failed to cite National Guard Regulation 600-101 (Warrant Officers-Federal Recognition and Related Personnel Actions) which requires successful completion of all phases of the Warrant Officer Candidate School.
7. The applicant's records should be corrected to show the effective date of permanent Federal Recognition in the grade of WO1 is 25 October 2006, the date he graduated from the Warrant Officer Candidate School.
8. Additionally, the applicant's records should be corrected to show he was promoted to CW2 effective 25 October 2008 and granted Federal Recognition on this date.
BOARD VOTE:
____x____ ____x____ ___x_____ GRANT FULL RELIEF
________ ________ ________ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING

BOARD DETERMINATION/RECOMMENDATION:
2. The Board determined that the evidence presented was sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20080013766, dated, 30 October 2008 to read:
a. amending NGB Special Orders Number 118 AR dated 8 May 2008 to show that the applicant was extended Federal Recognition for initial appointment effective 25 October 2006;
