IN THE CASE OF:
BOARD DATE: 27 January 2009
DOCKET NUMBER: AR20080017702
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
CONSIDERATION OF ADDITIONAL EVIDENCE:
17. On 10 October 2008, new information was received from the applicant and his counsel in regard to the Army Board for Correction of Military Records (ABCMR) Docket Number AR20080010484, dated 18 September 2008.
18. The evidence submitted consists of a statement, dated 10 October 2008, from the applicant's counsel wherein he stated that the applicant's unit of assignment during his service in the Republic of Vietnam, from 29 April 1969 to 7 April 1970, was Battery B, 6th Battalion, 11th Artillery, and that this unit was a subordinate unit to the Americal Division (23rd Infantry Division) vice the 25th Infantry Division as stated in the original proceedings.
ADDITIONAL DISCUSSION AND CONCLUSIONS:
6. At the time of the decision of the ABCMR in Docket Number AR20080010484, dated 18 September 2008, it was the intent of the ABCMR to portray the applicants service as administratively correct as it should properly have been at the time.
7. The ABCMR in Docket Number AR20080010484, dated 18 September 2008, erroneously showed B Battery, 2nd Battalion, 11th Artillery, as a subordinate unit to the 25th Infantry Division in paragraph 3b of the Consideration of Evidence.
8. Paragraph 3b, Consideration of Evidence, of the original Record of Proceeding should have listed B Battery, 2nd Battalion, 11th Artillery, as a subordinate unit to the 23rd Infantry Division (Americal Division).
9. As a result of the error, Good Conduct Medal Orders were issued showing the applicant was assigned to the 25th Infantry Division.
