THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of an earlier request for correction of his DD Form 214 (Report of Transfer or Discharge) to show award of the Bronze Star Medal.

2.  The applicant states that he was awarded the Bronze Star Medal for meritorious service in August 1969 in Vietnam.   

3.  The applicant provides a photograph of a Bronze Star Medal in support of his request.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080004201 on 10 July 2008.

2.  The new evidence submitted by the applicant will be considered by the Board.

3.  The applicant was inducted on 1 February 1968.  He arrived in Vietnam on 
15 September 1968.  He served as a heating and ventilation specialist and rations distribution supervisor assigned to Headquarters and Headquarters Company, 36th Engineer Battalion in Vietnam from 19 September 1968 through 14 August 1969.  On 30 January 1970, he was released from active duty.   

4.  The applicant’s DD Form 214 shows the National Defense Service Medal, two awards of the Overseas Service Bar, the Good Conduct Medal, the Vietnam Service Medal with two bronze service stars, the Republic of Vietnam Campaign Medal with Device (1960), and the Sharpshooter Marksmanship Qualification Badge with Rifle Bars (M-14 and M-16) as authorized awards.  

5.  Upon further review of the applicant's service personnel records, orders for the Bronze Star Medal were discovered.  Headquarters, 20th Engineer Brigade General Orders Number 909, dated 15 September 1969, show the applicant received the Bronze Star Medal for meritorious service during the period September 1968 to August 1969.

6.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam.  This document shows the applicant's unit is eligible for award of the Meritorious Unit Commendation for actions during the period 1 September 1968 to 31 December 1969 based on Department of the Army General Orders Number 51, dated 1971.

7.  Department of the Army Pamphlet 672-3 also shows the applicant's unit
is eligible for award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation based on Department of the Army General Orders Number 32, dated 1973.

8.  Department of the Army General Orders Number 8, 1974, announced award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation to Headquarters, U.S. Military Assistance Command and its subordinate units during the period 8 February 1962 to 28 March 1973 and to Headquarters, U.S. Army Vietnam and its subordinate units during the period 20 July 1965 to 
28 March 1973.

DISCUSSION AND CONCLUSIONS:

1.  Orders show the applicant received the Bronze Star Medal.

2.  The applicant's unit was cited for award of the Meritorious Unit Commendation and the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation while he was assigned to it.

3.  The Republic of Vietnam Gallantry Cross with Palm Unit Citation was awarded to all units which served in Vietnam.  The applicant served in Vietnam during a qualifying period and is eligible for this award.  Therefore, it would be appropriate to add this foreign unit award to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20080004201, dated 10 July 2008.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Bronze Star Medal, the Meritorious Unit Commendation, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Republic of Vietnam Gallantry Cross with Palm Unit Citation on his DD Form 214.
