IN THE CASE OF:
BOARD DATE: 3 February 2009
DOCKET NUMBER: AR20080015522
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show her foreign service in Iraq.
2. The applicant states, in effect, she deployed with members of her unit, Company E, 3rd Battalion, 227th Aviation Regiment, to Iraq during the period 2 February 2007 through 25 June 2007; however, her DD Form 214 does not reflect this.
3. The applicant provides:
a. her DD Form 214;
b. Orders Number 031-05, Headquarters, 1st Cavalry Division (Provisional)(Rear), Fort Hood, Texas, dated 31 January 2007, showing a temporary change of station (TCS);
c. a copy of a roster of personnel for TCS movement;
d. a copy of a memorandum from the Chief of Staff, 1st Cavalry Division, Iraq, directing the applicants redeployment to Fort Hood because she was pregnant; and
e. Orders 176-024, Headquarters, 1st Personnel Command, dated 25 June 2007, directing the applicants redeployment from Iraq to Fort Hood on 25 June 2007.
CONSIDERATION OF EVIDENCE:
1. The applicant was a Regular Army private first class (PFC/E-3) stationed at Fort Hood, Texas, and assigned to Company E, 3rd Battalion, 227th Aviation Regiment, as a petroleum supply specialist, military occupational specialty 92F.
2. The applicant was ordered to deploy on a TCS movement order to Iraq. She served in Iraq commencing on 2 February 2007. While in Iraq, it became known that she was pregnant and she was ordered back to Fort Hood. She departed Iraq on 25 June 2007.
3. Upon returning to Fort Hood, the applicant was honorably discharged under the provisions of Army Regulation 635-200 (Personnel Separations), chapter 8, by reason of pregnancy or childbirth.
4. The applicants DD Form 214 shows she served on active duty during the period 14 September 2005 through 10 August 2007. Item 12f (Foreign Service) does not show her Iraq service. Item 18 (Remarks) does not indicate Iraq service.
5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It establishes standardized policy for preparing and distributing the DD Form 214. It provides the following instructions to account for foreign service:
a. Item 12f enter the total amount of foreign service completed during the period covered by the DD Form 214.
b. Item 18 for an active duty Soldier deployed with his or her unit during their continuous period of active service, enter "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)."
DISCUSSION AND CONCLUSIONS:
1. During her incomplete first term of service, the applicant performed a TCS deployment to Iraq with selected members of her unit. She deployed on 2 February 2007, but she did not complete her deployment because she returned to her home duty station on 25 June 2007 due to pregnancy.
2. The applicant was deployed for 4 months and 24 days during the period 20070202 - 20070624. This service should be reflected in items 12f and 18 of her DD Form 214.
